Declaration of Policy
- National dispersion through regional agglomeration strategy to revitalize large cities.
- Metropolitan Davao designated as a special development and administrative region consisting of specific adjacent cities and municipalities in Davao Region.
Creation of the Metropolitan Davao Development Authority (MDDA)
- MDDA established as a special coordinating body within 30 days of the law's approval.
- Tasked with promoting socioeconomic growth and sustainable development of Metropolitan Davao.
- LGU autonomy preserved in purely local matters under the Constitution and Local Government Code.
Jurisdiction of the MDDA
- Covers Davao City; cities of Panabo, Tagum, IGaCoS, Digos, Mati; and specified municipalities in Davao provinces.
- Includes future cities or municipalities created within these LGUs as per law.
Scope of Services of MDDA
- Provides cross-boundary services that require coordination beyond individual LGUs, often costly if done separately.
- Services include:
- Development planning (medium- and long-term plans, project coordination).
- Transport management (policy formulation, mass transport system, traffic enforcement including single ticketing).
- Solid waste management (policies, sanitary landfill, waste reduction/reuse/recycle).
- Flood control and sewerage management.
- Urban renewal, zoning, land use planning, slum rehabilitation, shelter services.
- Health, sanitation, pollution control.
- Public safety (disaster preparedness and response).
Functions of the MDDA
- Formulate aligned development plans with regional and national plans.
- Set and enforce policies on traffic, waste, safety.
- Prepare and manage metropolitan-wide programs with Council approval.
- Review and recommend land development permits with metropolitan impact.
- Monitor program implementation and resolve issues.
- Administer single ticketing system, collect fines and penalties; regulate licensing.
- Prescribe and collect regulatory fees.
- Fix compensation for MDDA personnel.
- Perform other Council-approved functions consistent with the Act.
Metropolitan Davao Development Council (Governing Board)
- Composed of regional council chairperson, governors, city mayors, municipal mayors from constituent LGUs.
- Council Chairperson appointed by the President from nominees, serves a three-year term.
- Non-voting members include heads of key national government agencies in Davao.
- Members receive allowances and per diems per existing policies.
Functions of the Metropolitan Davao Development Council
- Approve development plans, investment programs, projects after stakeholder consultations.
- Issue ordinances, resolutions, and rules necessary for implementing the Act.
- Adjust allowances and per diems as lawful.
- Recommend investment programming and supervise plan implementation.
- Coordinate with Department of Transportation on public utility vehicle franchises.
- Approve and endorse the MDDA's annual and supplemental budgets.
- Perform other necessary actions for carrying out the Act.
Effectivity of Ordinances and Resolutions
- Ordinances/resolutions posted publicly and take effect 15 days after posting.
- Ordinances with penal sanctions require publication in a newspaper and take effect after 15 days.
Functions of the Chairperson of the Council
- Appointment and removal of MDDA personnel subject to civil service laws.
- Implement Council policies and manage daily operations.
- Prepare and submit annual budgets.
- Prepare staffing and discipline personnel per civil service rules.
- Submit annual accomplishment reports to Council and the President.
- Serve as member of Davao International Airport Authority Board.
- Perform other duties assigned by the President or Council.
- Assisted by General Manager and Assistant General Managers appointed by the President upon Council recommendation.
Functions of the General Manager
- Assist Chairperson in administration, supervision, plan review, and reporting.
- Perform duties delegated by the Chairperson.
Institutional Linkages
- MDDA to coordinate with LGUs, Regional Development Council, national agencies, NGOs, private sector.
- Adoption of a master plan aligned with regional development plans.
- Submit plans to Regional Development Council for integration.
- Enter MOAs for service delivery.
- Interface with foreign assistance agencies through NEDA and DOF for financing support.
Metropolitan Davao Police District (MDPD)
- Established under National Police Commission control, headed by Police Brigadier General.
- Assumes operational control over local police in MDDA jurisdiction.
- Maintains peace, order, and safety.
- Integrates law enforcement and coordinates with MDDA, Regional Police, LGUs.
Sources of Funds and Operating Budget
- Funding included in annual General Appropriations Act.
- Supported by member LGU contributions, national agencies, GOCCs, private sector, grants, donations, fees, and charges.
- Acceptance of foreign grants and donations subject to Council, President, and appropriate Secretary approval.
- MDDA empowered to levy fines and fees.
- Council to negotiate financial commitments from LGUs and GOCCs.
Implementing Rules and Regulations
- Council to promulgate necessary implementation rules within 90 days post-enactment.
Separability Clause
- Invalidity of any provision does not affect remaining parts of the Act.
Repealing Clause
- Laws and orders inconsistent with this Act are repealed or modified accordingly.
Effectivity
- Act takes effect 15 days after publication in the Official Gazette or a newspaper of general circulation.
