Issuance and Effect of Emancipation Patent and/or Grant

  • After fulfillment of requirements under PD No. 27 by tenant-farmers, the DAR issues an Emancipation Patent and/or Grant based on an approved survey plan.
  • If the land is already registered under the Torrens system, the Emancipation Patent and/or Grant, when filed with the Register of Deeds, acts as conclusive authority to transfer the certificate of title.
  • Before cancelling the original title and issuing a new one to the grantee, the Register of Deeds requires surrender of the owner’s duplicate certificate of title within a reasonable period.
  • If the duplicate certificate is not surrendered within 30 days after notice, the Register of Deeds may cancel the original and duplicate certificates and issue a new certificate of title in favor of the grantee.
  • For unregistered lands, the filing of the Emancipation Patent and/or Grant with the Register of Deeds brings the land under the operation of Act 496 (Land Registration Act) making it considered registered land.
  • The Register of Deeds then enters an original certificate of title and issues the owner’s duplicate certificate to the grantee.

Fees, Taxes, and Charges

  • No fees, premiums, or taxes shall be imposed or charged for the issuance and registration of documents and titles under this Decree.
  • Postage dues and mailing charges are waived in connection with implementation matters under this Decree.
