Law Summary
Issuance and Effect of Emancipation Patent and/or Grant
- After fulfillment of requirements under PD No. 27 by tenant-farmers, the DAR issues an Emancipation Patent and/or Grant based on an approved survey plan.
- If the land is already registered under the Torrens system, the Emancipation Patent and/or Grant, when filed with the Register of Deeds, acts as conclusive authority to transfer the certificate of title.
- Before cancelling the original title and issuing a new one to the grantee, the Register of Deeds requires surrender of the owner’s duplicate certificate of title within a reasonable period.
- If the duplicate certificate is not surrendered within 30 days after notice, the Register of Deeds may cancel the original and duplicate certificates and issue a new certificate of title in favor of the grantee.
- For unregistered lands, the filing of the Emancipation Patent and/or Grant with the Register of Deeds brings the land under the operation of Act 496 (Land Registration Act) making it considered registered land.
- The Register of Deeds then enters an original certificate of title and issues the owner’s duplicate certificate to the grantee.
