Definitions
- "Manpower": portion of the population with actual or potential capability to contribute to production of goods and services.
- "Out-of-school youth": individuals aged 12 to 17 years not enrolled in formal academic or vocational training recognized by the government.
National Manpower and Youth Council: Creation and Composition
- Created under the Office of the President.
- Composed of ex-officio members: Secretary of Labor (Chairman), Secretary of Education (Vice-Chairman), Chairman of National Economic Council, Secretary of Agriculture and Natural Resources, Secretary of Social Welfare, Secretary of Community Development, Chairman of National Science Development Board.
- Director-General of the Council as non-voting member.
- Private sector members appointed by the President (with Commission on Appointments' consent): 2 industry representatives, 2 labor representatives, 2 family and youth organization representatives.
- Members serve 3-year terms, receive per diems and travel expenses.
- Council meets as often as necessary, not exceeding 30 times per year.
Functions and Duties of the Council
- Formulate integrated, comprehensive, long-term plans for manpower and out-of-school youth development.
- Organize voluntary training centers, programs, and projects to achieve objectives.
- Establish National Manpower Skills Center for research and demonstration.
- Set policies and standards for manpower and youth training.
- Conduct studies on population and labor force characteristics.
- Administer existing manpower and development programs across government.
- Enter agreements with foreign/international organizations for training.
- Evaluate human resource development outputs to align with economic development plans.
- Provide training assistance to employers upon petition, ensuring trainees are likely to be employed after training.
- Submit annual reports to the President and Congress.
- Perform other necessary functions to fulfill national policy.
Council Secretariat
- Headed by a Director-General appointed by the President with Council recommendation and Commission on Appointments consent.
- Director-General holds rank and salary of undersecretary, serves a 10-year term.
- Secretariat includes Office of Manpower Planning and Development, Office of Out-of-School Youth Development, and National Manpower Skills Center.
- Directors of offices and Skills Center hold bureau director rank, subject to civil service rules.
- Qualification requirements include natural-born citizenship, age 35-50, master's degree or equivalent, and experience.
Manpower Training and Youth Consultative Boards
- Manpower Training Consultative Board: up to 10 members, provides technical guidance, accreditation standards, includes representatives from labor and industry.
- Youth Consultative Board: up to 10 members, provides guidance on youth training and development, includes Women and Minors Bureau director.
- Boards’ honoraria and expenses determined by the Council.
- Secretariat may seek technical guidance from experts as needed.
Local Manpower and Youth Committees
- Established in provinces and chartered cities with Council approval.
- Committees exclude members from the Armed Forces or Philippine Constabulary.
- Responsible for accelerated manpower training, youth projects, and manpower needs assessment locally.
- Membership includes local development board head (chair), training center head (vice-chair), industry leader, labor leader, and civic/education leader.
- Members serve 3-year terms, receive per diems and travel expenses.
Employment Service Training Functions
- Department of Labor's Office of Manpower Services assists the Council.
- Tasks include measuring unemployment, conducting labor surveys and occupational studies.
- Establish and maintain national register of trained technicians and skilled manpower.
- Local employment offices organized under Department of Labor supervision.
Qualifications and Appointment of Personnel
- Director-General appoints personnel subject to civil service rules.
- Permanent appointments require successful completion of relevant career development courses.
- Competitive examinations by Civil Service Commission and Council required one year post-Act approval.
- Emphasis on selection based on superior performance standards.
Other Training Programs
- To avoid duplication and waste, current government training programs not covered by this Act shall be discontinued.
- Funds used in existing programs revert to their respective offices.
Rules and Regulations
- The Council is empowered to issue necessary implementing rules and regulations.
Appropriations
- Initial appropriation of P20 million for Act implementation.
- Allocation includes:
- P2 million for personnel and maintenance.
- P6 million for establishing National Manpower and Skills Center.
- P6 million for manpower training centers locally.
- P6 million for out-of-school youth center operations.
- Subsequent necessary funds included in General Appropriations Act.
Separability Clause
- Invalidity of any provision does not affect other parts of the Act.
Repealing Clause
- Repeals all inconsistent laws, including Executive Orders No. 83 (1967) and No. 53 (1966).
Effectivity Clause
- The Act takes effect immediately upon approval.
