Mandatory Philippine National Standards for household and similar electrical appliances require compliance from manufacturers and importers, ensuring safety through certification and market surveillance by the Department of Trade and Industry.

Scope and Coverage of the Standards

  • The mandatory standards apply to a wide range of household and similar electrical appliances, including electric irons, spin extractors, washing machines, toasters, kitchen machines, appliances for heating liquids, refrigerators, microwave ovens, air-conditioners, fans, and certain audio-video equipment.
  • Appliances used in commercial establishments that pose a public danger are also covered.
  • Industrial-use exclusive appliances are excluded from this Order.

Compliance Requirement for Manufacturers and Importers

  • All manufacturers and importers of the covered products are required to comply with the specified mandatory Philippine National Standards.
  • They must secure appropriate certifications before distributing or selling the products in the market.

Certification and Third-Party Scheme

  • The DTI-Bureau of Philippine Standards (BPS) administers a Product Certification Scheme.
  • Manufacturers must obtain a Philippine Standard (PS) Quality and/or Safety Certification Mark License.
  • Importers must secure an Import Commodity Clearance (ICC).
  • Certification must be secured prior to product distribution and sale.

Authorities and Responsibilities

  • Duties of DTI and BPS align with those specified in earlier DAOs (4:2008, 5:2008).
  • They are responsible for processing applications, inspection, surveillance, testing, and enforcement.

Application Process for Certification

  • Manufacturers apply for PS Certification Mark Licenses per DAO 4:2008.
  • Importers apply for ICC in accordance with DAO 5:2008.

Sampling Procedures

  • Random sampling from shipments for importers and production lines for manufacturers is mandated.
  • Quantity of samples depends on the type of appliance.
  • Test samples must not be specially prepared or modified before testing.

Testing Procedures

  • Manufacturers must conduct in-plant testing using required equipment as part of quality control.
  • Independent testing must be conducted by BPS-recognized laboratories at specified electrical ratings.
  • Full testing applies to base models; verification testing applies to generic models unless non-conformance is found.
  • Testing confidentiality is maintained; test reports are for certification purposes only.

Required Product Markings

  • Products must bear markings as prescribed by relevant PNS, previous DAOs, and the Consumer Act of the Philippines (Republic Act No. 7394).

Disposition of Samples

  • Tested samples must be retrieved by manufacturers/importers within 30 days of notification.
  • Failed samples may be stored for reference in case of contestation for up to 2 months, after which samples may be returned or disposed of following regulations.
  • BPS and laboratories are not liable for damages during transport or testing.
  • Disposal of hazardous samples is the responsibility of the manufacturer/importer.

Market Monitoring and Enforcement

  • BPS, FTEB, and DTI regional/provincial offices have authority to monitor and inspect market products at any time.
  • Non-compliance results in legal actions or sanctions according to applicable laws and regulations.

Separability Clause

  • If any provision is declared invalid, other provisions not affected shall remain in force.

Repealing Clause

  • This DAO repeals previous memorandums, guidelines, or orders inconsistent with its provisions.

Transitory Provisions

  • A 6-month voluntary certification period is allowed post-effectivity.
  • Mandatory certification after 6 months from effectivity date.
  • All covered products must bear valid certification marks or stickers after 18 months.
  • Previously issued PS licenses remain valid until expiration unless revoked.

Effectivity

  • The DAO takes effect 15 days after publication in a national newspaper and filing with the UP Office of National Administrative Register.
  • Dated January 29, 2018, signed by officials of BPS, Consumer Protection Group, and the Secretary of Trade and Industry.
