Election timing, method, and proclamation activation
- Section 3 makes the Act’s effectivity province-specific: it takes effect in each covered province when the President has ascertained and declared by proclamation that the people of that province are ready to elect the provincial governor and provincial board members.
- Section 3 mandates that the election of the provincial officials in each activated province must be held at the same time as the regular election for provincial offices throughout the Philippines.
- Section 3 requires that the election be conducted in accordance with the provisions of the Election Code.
Repeal of compensation-related exclusions
- Section 2 repeals specific compensation-classification exclusions found in Section 3 of Act No. 3798 and Section 1 of Act No. 3207.
- Section 2 limits the repeal to the parts of those provisions that specifically refer to the provinces enumerated in Section 1 and that treat those provinces as not embraced in the general classification of provinces for purposes of fixing compensation for provincial officials.
- Section 2 repeals those portions to align compensation classification with the scheme stated in Section 1.
Effectivity and approval
- The Act is Approved, October 17, 1946.
- The Act’s operative elections for each province become effective only through a presidential proclamation under Section 3 confirming readiness to elect.
- The elections must be synchronized with the regular provincial election schedule and run under the Election Code as required by Section 3.
