Definition of Vital Industries
- Vital industries include sectors whose disruption could severely affect the public interest, national security, or economic stability.
- These industries are broadly categorized into public utilities, manufacturing of essential commodities, export-oriented companies, mining and exploration, banking, government infrastructure, healthcare, and education.
Public Utilities
- Transportation: All companies or firms engaged in land, air, and water transport for passengers, freight, or tourism; brokerage, arrastre, and warehousing services.
- Communications: Wire/wireless telecommunications firms (telephone, telegraph, telex, cable), radio and television companies, print media, postal and messengerial services.
- Utilities: Companies engaged in generation and distribution of electricity, light, gas, steam, water power, and sanitary services.
- Other public utilities include ice and refrigeration plants.
Essential Commodities Manufacturing
- Companies processing or manufacturing the following essential commodities are considered vital:
- Animal feeds
- Cement
- Chemicals and fertilizers
- Drugs and medicines
- Flour
- Other essential commodities as per the National Economic and Development Authority list, excluding rice, corn, some basic meat cuts, cooking oil, laundry soap, lumber and plywood, galvanized iron sheets, writing pads, and notebooks
- Iron, steel, copper, tin plates, and other basic mineral products
- Milk
- Newsprint
- Tires
- Sugar
- Textile and garments
Export-Oriented Companies
- Companies with Central Bank or Board of Investments Certificate of Export Orientation engaged in the production and processing of export products.
- Includes hotels and restaurants classified as three, four, or five stars by the Department of Tourism.
Mining and Exploration
- Companies engaged in exploration, development, mining, smelting, or refining of coal, oil, iron, copper, gold, and other minerals.
Banking Institutions
- All types of banking institutions are considered vital, including:
- Commercial banks
- Savings banks
- Development banks
- Investment banks
- Rural banks
- Savings and Loans associations
- Cooperative banks
- Credit unions
Government Infrastructure and Defense Contracts
- Companies or firms actively involved in government infrastructure projects or activities related to Defense contracts are included.
Healthcare
- Hospitals as defined under the Rules and Regulations Implementing the Labor Code of the Philippines (Section 2, Rule 1-A, Book III).
Education
- Schools and colleges duly recognized by the government.
Authority to Modify the List
- The Secretary of Labor is empowered to include or exclude industries, firms, or companies from the list based on considerations of national interest, national security, or general welfare.
Implementation and Effect
- The directive is issued to guide labor relations and industrial peace particularly by identifying vital sectors where work stoppages have significant impact.
- Issued under the authority of the President of the Philippines, reflecting the priority of safeguarding critical industries and services.
