- Meets educational needs of Leyte Province and Eastern Visayas region.
- Existing high schools transferred to Department of Education jurisdiction.
- High schools on campus allowed to operate until current students graduate.
- May operate a laboratory school if it has a College of Education.
University Administration
- General corporate powers under Corporation Code of the Philippines.
- Administration vested in Board of Regents and University president as authorized.
Governing Board Composition
- Board of Regents chaired by CHED Chairperson, with University president as vice chair.
- Members include congressional committee chairs, regional directors of NEDA and DOST, federation presidents (faculty, students, alumni), and two prominent citizens.
- Two prominent citizens appointed for two-year terms from qualified nominees.
- Federation presidents serve contemporaneous terms.
Policy Promulgation and Implementation
- Board shall implement policies consistent with State and CHED's educational policies under Republic Act No. 7722.
Powers and Duties of the Board of Regents
- Promulgate rules and regulations necessary for the University.
- Approve funding allocation and receive donations exempt from donor's tax.
- Fix tuition and school-related fees; fees form special trust funds.
- Socialized tuition scheme to assist poor but deserving students.
- Authorize construction, acquisition of property, appointment and removal of officials.
- Approve curricula, admission and graduation policies.
- Award honorary degrees and certificates.
- Establish branches, research centers, chairs, fellowships, and scholarships.
- Delegate powers to expedite administration.
- Authorize management audits and institute reforms.
- Establish linkages with government, business, local and foreign institutions.
- Set academic arrangements and adopt innovative teaching methods.
- Private management of non-academic services as advantageous.
- Extend university president's term up to age 70 upon outstanding performance.
Board Meetings and Attendance
- Regular meetings at least quarterly; special meetings as needed with prior notice.
- Quorum is majority with CHED Chair or University president present.
- CHED Chair may designate commissioner to represent or preside.
- Congressional committee chairs may designate representatives.
- Board members receive no salary but reimbursement for official expenses.
University Presidency
- President appointed by Board upon search committee recommendation, serves four years with one reappointment.
- Incumbent LIT president to be first EVSU president if qualified.
- Assisted by Academic Affairs Vice President appointed for three years.
- Vacancy filled by officer-in-charge for unexpired term.
- Powers include usual university presidential duties and Board delegations.
- Salary in accordance with Revised Compensation and Position Classification System.
Administrative Council
- Composed of president, vice presidents, deans, directors, and equivalent officials.
- Reviews and recommends policies on administration and development.
Academic Council
- Composed of president as chair and academic staff of at least assistant professor rank.
- Reviews and recommends curricular offerings and disciplinary rules.
- Fixes student admission, graduation requirements, and exercises disciplinary power.
Secretary and Treasurer
- Secretary appointed to keep Board records and notify members of meetings.
- Treasurer of the Philippines serves ex officio as University Treasurer.
Faculty Appointment Principles
- No inquiry into political beliefs, gender preference, cultural or ethnic origin, or religion.
- Faculty prohibited from promoting or opposing any religious sect.
Scholarship and Admission Policy
- Scholarship programs for poor but deserving students.
- No admission denial based on sex, religion, culture, ethnicity.
Academic Freedom and Institutional Autonomy
- University enjoys academic freedom and autonomy pursuant to Constitution.
Authority to Loan or Transfer Resources
- Government agencies may loan equipment, supplies, and detail employees to University upon request.
- Time spent by detailed employees counted as regular service.
Transfer of Assets and Liabilities
- All assets, liabilities, personnel and records of LIT transferred to University.
- Positions and rights of personnel preserved.
- Government-owned land occupied by integrated campuses (except main campus land) transferred to University.
- If University ceases or land no longer needed, property reverts to Province of Leyte.
Appropriations and Funding
- Initial funding charged to LIT's current appropriations except funds for existing high schools.
- Subsequent funding included in annual General Appropriations Act.
Development Plan and Audit Requirements
- Within 120 days, University must submit a 5-year development plan and program budget to CHED.
- Undergo management audit with CHED cooperation.
- Set up organizational, administrative, and academic structure.
Reporting Requirements
- Board must file a detailed report on University's progress, conditions, needs annually to the President, CHED, and Congress.
Inclusion of Higher Education Modernization Act
- Republic Act No. 8292 (Higher Education Modernization Act of 1997) forms integral part of this law.
Repealing Clause
- Laws, orders, rules contrary to this law are amended, repealed, or modified accordingly.
Effectivity
- Law takes effect upon approval.
