Board of Environmental Planning Creation and Composition
- A Board composed of one chairman and two members is created within 30 days of the Decree approval.
- Board members are appointed by the President based on recommendations from the Philippine Institute of Environmental Planners.
- Initial terms are staggered: one year, two years, and three years; thereafter, three-year terms.
Board Member Qualifications and Removal
- Must be a Filipino citizen, resident, at least 30 years old, and possess good moral character.
- Educational requirements: degree in environmental planning with at least 3 years experience or degree in related fields with 5 years experience.
- Board members must be registered environmental planners; first Board members become registered upon appointment.
- Removal grounds include neglect, incompetence, malpractice, unethical or immoral conduct after investigation.
Powers and Duties of the Board
- Issue, suspend or revoke registration certificates.
- Recognize specialized training and approve registration without examination (under conditions).
- Prescribe examination content and administer licensing exams.
- Adopt a Code of Ethics and official seal.
- Inspect educational institutions yearly to maintain education standards.
- Investigate violations, issue subpoenas, conduct hearings on administrative cases.
- Promulgate decisions and issue necessary rules with Commission approval.
Fees and Reports
- Application fee is PHP 100, registration fee PHP 50.
- Board members compensated per applicant examined, and per diem for attendance, capped annually.
- The Board must submit an annual report summarizing its activities and recommendations.
Registration and Examination Requirements
- No one may practice environmental planning without proper registration.
- Applicants must pass a professional licensure examination unless qualifying for registration without exam within one year of Board constitution.
- Registration without examination requires proof of citizenship, age, current practice, and specific academic and experiential qualifications ranging from master's degrees to civil service eligibility with corresponding years of experience.
Examination Regulations
- Conducted once a year in Metro Manila.
- Subjects include physical, social, economic planning, planning law and administration, and special planning studies.
- Applicants must fulfill age, citizenship, and educational plus experience qualifications.
Registration Restrictions and Oath
- Certificate denied if applicant convicted of crimes involving moral turpitude or immorality, or is of unsound mind.
- Successful candidates must take a professional oath before practicing.
Practice Restrictions and Responsibilities
- Only registered environmental planners may provide the defined environmental planning services.
- Only planners themselves may sign and seal plans; unauthorized use or alteration of plans is prohibited.
- Environmental planners in charge bear full responsibility for documents under their seal.
Corporate Practice of Environmental Planning
- Consulting firms and corporations may engage in environmental planning if 75% of the board members are registered planners and 75% of the capitalization is owned by these planners.
- The practice must be conducted by registered environmental planners.
Record-Keeping and Certificate Regulation
- A roster of registered planners is maintained and made available to relevant government agencies and the public.
- Certificates may be suspended or revoked after due process.
- Re-issuance of certificates possible after at least one year following revocation.
- Registered environmental planners must have and use an official seal with certificate number.
Enforcement and Penal Provisions
- Government officials must assist in enforcing the Decree and appoint only qualified planners for relevant positions.
- Penalties for violations include imprisonment (6 months to 5 years), fines (PHP 2,000 to PHP 5,000), or both.
- Specific offenses include practicing without registration, using false certificates, impersonation, unauthorized use of titles, and violating provisions.
- Corporate officers responsible for violations may be penalized.
Repealing and Separability Clauses
- Conflicting laws and regulations are repealed or modified.
- If any part is declared unconstitutional, the rest remains valid.
Effectivity
- The Decree takes effect six months after the Board’s constitution.
