Authority Delegation to Regional Managers
- All Regional Managers, except for the National Capital Region (NCR), are authorized to issue provisional authorities.
- Provisional authorities are granted pending the hearing and final resolution of the applications.
Conditions for Issuance of Provisional Authority
- Applicants must pay the necessary filing fees for the regular Certificate of Public Convenience (CPC).
- An additional fee of P150.00 per applicant per case must be paid as required by BP No. 134.
- All documents required for a regular CPC application must be attached.
- The Route Market Classification (RMC) for the applied route must be open.
Validity and Duration of Provisional Authority
- The provisional authority is valid only for two (2) months or until the CPC is issued, whichever period is shorter.
Effectivity and Supersession
- This Memorandum Circular takes effect immediately upon issuance.
- It supersedes any inconsistent provisions of existing Memorandum Circulars or Board rules and regulations.
Legal and Administrative Compliance
- Strict compliance with the provisions is mandated.
- Signed and adopted by the Chairman and Board Members of the Land Transportation Franchising and Regulatory Board (LTFRB) on January 30, 1992.
