The Integration Act of 1975 established the Integrated National Police in the Philippines, responsible for public safety, law enforcement, and maintenance of peace and order, under the command of the Director-General and the Department of National Defense.

Jurisdiction and public safety mandate

  • The Integrated National Police is responsible for public safety, protection of lives and properties, enforcement of laws, and maintenance of peace and order within the territorial limits of the Philippines.

Director-General and command structure

  • The head of the Integrated National Police is known as the Director-General and is the Chief of Constabulary.

Presidential supervision and Department placement

  • The Integrated National Police is subject to the command and general supervision of the President of the Philippines in the exercise of its power to maintain peace, law, order, and public safety.
  • The Integrated National Police functions directly under the Department of National Defense.

Transfers from National Police Commission

  • The National Police Commission, whose officials and personnel are exempt from the operation of wage and position classification laws and regulations, is transferred to the Department of National Defense.

  • Powers and functions relating to attestation of appointments, examination, investigation, adjudication and review of police administrative disciplinary cases, adjudication and grant of compensation for permanent disability and death benefits, staff inspection and audit extend to firemen and jail guards.
  • Powers and functions of the National Police Commission over local police agencies extend to the police, fire and jail components of the Integrated National Police unless otherwise provided.

Hearing officers, boards, and appeals

  • The jurisdiction of Hearing Officers to investigate administrative complaints against members of the police force and claims for permanent disability and death benefits extends to firemen and jail guards.
  • The jurisdiction of Adjudication Boards to decide such cases extends to firemen and jail guards.
  • The jurisdiction of the Special Appellate Committee to review decisions of dismissals rendered by the boards extends to firemen and jail guards.

Subpoena authority for investigations

  • The Chief of Constabulary, or a subordinate official he may authorize, has the power to issue subpoena and subpoena duces tecum in connection with the investigation of cases cognizable by the Integrated National Police.

Rules and regulations power

  • The Chief of Constabulary must promulgate the necessary rules and regulations for the effective implementation of the Decree.
  • The promulgation must be done with the approval of the Secretary of National Defense.

Criminal penalty for obstruction

  • Any person who obstructs or interferes with the implementation of this Decree or the rules and regulations promulgated by the Chief Constabulary in accordance with it, directly or indirectly, is subject to imprisonment of not less than three years nor more than six years and/or a fine of not less than PHP 5,000 nor more than PHP 10,000 at the discretion of the court.
  • If the offender is a public officer or employee, the offender may be disqualified from holding public office or employment for life, in addition to other penalties.

Integration rules, repeal, and transition

  • Provisions of earlier integration Decrees—Presidential Decrees Nos. 421, 482, 531, 585, 632 and 641—are applicable to the Integrated National Police unless inconsistent with Presidential Decree No. 765.
  • Republic Act No. 4864 (otherwise known as the Police Act of 1966), as amended by numerous specified Presidential Decrees, and the provisions of the charters of all cities, and pertinent provisions of the Revised Administrative Code, as amended, and all other inconsistent provisions of existing laws, executive orders, rules and regulations are repealed or modified accordingly.
  • Before the rules and regulations implementing Section 9 are promulgated by the Chief of Constabulary as approved by the Secretary of National Defense, city and municipal governments must continue providing the usual funds and logistical support under existing laws to their respective city and municipal police forces, jails and fire departments, including payment of salaries, allowances and benefits to personnel.
  • During the interregnum before implementation, the National Police Commission continues to grant salary subsidies under existing laws.

Effectivity and approval

  • Presidential Decree No. 765 takes effect upon approval.
  • The Decree is dated August 08, 1975.
