Policy basis and purpose
- The order is anchored on Section 5(3) of Article XVI of the 1987 Philippine Constitution, which mandates that adequate remuneration and benefits of armed forces members and professionalism in the armed forces are a prime concern of the State.
- The order is justified by the State’s recognition of the heroism and sacrifices of frontline soldiers and police officers engaged in actual combat against groups threatening national peace and security.
- The order is issued to increase living conditions of men in uniform engaged in combating threats to national security and public peace and order.
Combat Duty Pay rate and entitlement
- The Combat Duty Pay of officers and enlisted personnel of the AFP and uniformed personnel of the PNP is fixed at PHP 3,000.00 per month (Section 1).
- AFP officers and enlisted personnel performing combat duties/activities are entitled to Combat Duty Pay (Section 2).
- PNP uniformed personnel engaged in actual police operations, as defined in regulations to be issued by the Secretary of National Defense and the National Police Commission, are entitled to Combat Duty Pay (Section 2).
- Entitlement is tied to the performance of the respective combat duties/activities or actual police operations under the definitions in the forthcoming regulations (Section 2).
Combat Incentive Pay: additional daily pay
- AFP members and PNP uniformed personnel who figure directly in actual combat against members of insurgent, terrorist and lawless elements are entitled to an additional Combat Incentive Pay of PHP 300.00 per day (Section 3).
- The additional incentive is subject to the following conditions (Section 3):
- The operation must be a specific combat mission covered by an OPORD or FRAG-O for the AFP or a Mission Order for the PNP.
- The personnel involved in combat must be in the published task organization of the AFP OPORD/FRAG-O or the PNP Mission Order.
- The total additional Combat Incentive Pay for each individual must not exceed PHP 3,000.00 per month.
- The Combat Incentive Pay is over and above the Combat Duty Pay of PHP 3,000.00 for qualified AFP officers and enlisted personnel and qualified PNP uniformed personnel (Section 3).
Funding and roster validation
- Implementation funding initially comes from the Miscellaneous Personnel Benefits Fund (Section 4).
- Succeeding funding is included in the AFP and PNP specific budgets in the General Appropriations Act (Section 4).
- Funding is subject to submission of the actual roster of military and uniformed personnel of the AFP and PNP to the Department of Budget and Management (Section 4).
- The validated list is the basis for allocating funds in succeeding years (Section 4).
Separability, repeal, and effectivity
- Separability: If any provision is declared invalid or unconstitutional, the remaining provisions remain valid and subsisting (Section 5).
- Repeal: All executive orders, rules and regulations, and other parts inconsistent with the Executive Order are revoked, amended, or modified accordingly (Section 6).
- Effectivity: The Executive Order takes effect starting 01 September 2016 (Section 7).
