Amended criminal liability for wage increase violations
- Section 1 amends Section 12 of Republic Act No. 6727 to impose criminal penalties for refusal or failure to pay prescribed wage increases or adjustments made in accordance with Republic Act No. 6727.
- Section 1 makes liability attach to any person, corporation, trust, firm, partnership, association or entity that refuses or fails to pay any prescribed increase or adjustment in the wage rates.
- Section 1 requires punishment by a fine of not less than PHP 25,000 nor more than PHP 100,000 or imprisonment of not less than two (2) years nor more than four (4) years, or both, at the discretion of the court.
- Section 1 bars any person convicted under Republic Act No. 8188 from the benefits provided for under the Probation Law.
- Section 1 orders the employer concerned to pay an amount equivalent to double the unpaid benefits owing to the employees.
Double indemnity and its limits
- Section 1 requires the payment of double the unpaid benefits to employees as an additional consequence of conviction.
- Section 1 states that payment of indemnity does not absolve the employer from the criminal liability imposable under this Act.
Corporate responsibility: imprisonment on responsible officers
- Section 1 provides that when the violation is committed by a corporation, trust or firm, partnership, association or any other entity, the penalty of imprisonment is imposed upon the entity’s responsible officers.
- Section 1 identifies responsible officers to include, but not limited to, the president, vice-president, chief executive officer, general manager, managing director or partner.
- Section 1 makes the responsible officers subject to imprisonment even though the entity is the violating employer.
Repeal or modification of inconsistent rules
- Section 2 repeals or modifies all laws, presidential decrees, executive orders, rules and regulations, or parts thereof, that are inconsistent with Republic Act No. 8188.
- Section 2 limits the repeal or modification to inconsistency with Republic Act No. 8188.
