Notice Requirements for Summary Settlement

  • Notice must be given in ordinary form and by publication once a week for three consecutive weeks in a newspaper of general circulation in the locality.
  • If publication is not possible, the court may prescribe other forms and distribution methods for notices.

Court Procedure for Summary Settlement

  • The Court of First Instance may proceed summarily without appointing an executor, administrator, or appraiser.
  • No formal allowance of claims against the estate is required before proceeding.
  • The court may grant allowance of the will if one exists.
  • The court determines the persons legally entitled to the estate.
  • The estate is apportioned and divided among heirs after payment of debts deemed due by the court.

Rights and Obligations of Heirs or Beneficiaries

  • Heirs or beneficiaries of lawful age and legal capacity may receive and enter possession of their portions immediately.
  • Minors or legally incapacitated persons may receive possession through guardians or trustees duly appointed and qualified.
  • The court may require furnishing of bonds to cover any claim against their portions.

Period for Claims Against the Settlement

  • Any creditor, heir, or other person deprived of lawful participation may file claims within two years from the date the court’s order of partition or award is entered in the docket.
  • If the claimant is a minor, mentally incapacitated, imprisoned, or abroad at expiration of the two-year period, they may file within one year after impediments cease.

Court Orders, Costs, and Recordation

  • The court shall issue just orders concerning the costs of the proceeding.
  • All orders and decrees must be filed and recorded in the clerk’s office.
  • Orders or awards covering real estate shall also be recorded in the appropriate register’s office.

Effective Date

  • The Act takes effect upon approval as provided in the last section of the law.
