Implementation of the Third Tranche Salary Adjustments for Civilian Personnel

Implementation of the Third Tranche for Local Government Units (LGUs)
- The implementation for LGUs depends on the financial capability and income class determined by the sanggunian (local legislative council).
- Salary rates must not exceed specified percentages of the Annex A rates, varying by LGU class, with specific caps for provinces/cities and municipalities from Special to 6th class.
- Personal Services (PS) cost resulting from the salary adjustments must comply with PS limitations under Sections 325(a) and 331(b) of RA No. 7160.
- No decrease in existing salaries is allowed to meet PS limitations.
- The Department of Budget and Management (DBM) will issue salary schedules for LGUs effective no earlier than January 1, 2012.
Inapplicability to Certain Officials
- No salary increase shall take effect until after the expiration of the full term of all members of the Senate and the House of Representatives who approved the increase, pursuant to Section 10, Article VI of the Constitution.
Funding Sources for Salary Adjustments
- NGAs: Funded from the Miscellaneous Personnel Benefits Fund (MPBF) under the FY 2011 General Appropriations Act and available savings; future funding to be included in subsequent GAAs.
- GOCCs and GFIs: Funded from their respective corporate funds in approved operating budgets.
- LGUs: Funded from respective local government funds.
Uniform Implementation and Insufficiency of Funds
- GOCCs and GFIs lacking sufficient funds shall implement uniform percentage-based salary schedules based on Annex A rates.
- LGUs lacking sufficient funds shall implement salary schedules at uniform percentages based on the Third Tranche Monthly Salary Schedule for their income class.
Implementing Rules and Regulations
- The DBM is tasked with issuing the necessary rules and regulations to implement this Executive Order.
Separability Clause
- If any provision is declared invalid or unconstitutional, the remaining provisions not affected shall continue to be valid and effective.
Repealing Clause
- All conflicting orders, rules, regulations, or issuances or parts thereof are repealed, amended, or modified to conform with this Executive Order.
Effectivity
- The Executive Order takes effect immediately upon issuance on April 29, 2011.
