Creation and Powers of the BCDA
- BCDA is established with the authority to source capital from the sale of designated military camps.
- Exempted are lands that remain military reservations as declared by the President.
- BCDA is mandated to prepare and implement a comprehensive development plan including projects from the Legislative-Executive Bases Council (LEBC) framework.
Presidential Authorization for Land Disposition
- The President must authorize BCDA’s disposition of areas in Fort Bonifacio and Villamor Air Base six months after Act approval.
- No land disposition can proceed without an approved development plan.
Population Resettlement Authority
- BCDA may plan and execute relocation or resettlement of populations within its jurisdiction if necessary.
Master Plan and Fund Generation Scheme
- A master development plan and securitization scheme for Fort Bonifacio and Villamor Air Base were prepared by the Public Estates Authority with multiple government agencies' collaboration.
- This plan constitutes BCDA’s initial fund generation program.
Contracting and Coordination for Project Implementation
- BCDA is authorized to enter into contracts with relevant government or private entities to implement initial projects.
- Close coordination among BCDA and concerned agencies is necessary for successful implementation.
Transfer of Military Camp Portions to BCDA
- Specific Metro Manila military camps, excluding certain exceptions, and the JUSMAG compound are transferred to BCDA.
- Department of Environment and Natural Resources (DENR) and related agencies must facilitate the documentation and processing for transfer.
Appraisal and Capitalization
- Transferred properties must be appraised for appropriate valuation.
- This valuation will be recorded in BCDA’s books as part of its capitalization.
Funds Generation Properties and Disposition Timetable
- Properties earmarked for disposition are listed along with timelines:
- Within 15 months: Fort Bonifacio Heritage Park, Military Housing, Mixed Commercial/Industrial Center, portions of Villamor, Camp Claudio, Camp Bago Bantay, Jusmag Compound.
- Within 3 years: Camp Ver, Camp Melchor, Camp Atienza.
- Additional areas may be disposed of after initial projects are implemented.
Authority to Partner with Project Managers
- BCDA may enter Memoranda of Agreement with Public Estates Authority or private/government corporations as Project Managers.
- Agreements must define responsibilities and terms.
Assistance from Government Agencies
- Various agencies including DND/AFP, DENR, PNB, Securities and Exchange Commission, HLURB, and National Housing Authority are directed to assist BCDA.
- Coordination with DND/AFP is required for development access and related matters.
Repeal of Inconsistent Issuances
- Any previous Executive Orders or Administrative Orders inconsistent with this Executive Order are repealed or amended accordingly.
Effectivity
- This Executive Order is effective immediately upon issuance on December 8, 1992.
