Purpose of the Guidelines
- To establish rules governing the showing/exhibition of videograms or films onboard Philippine-registered vessels in domestic trade.
- To supplement HPCG Memorandum Circular No. 02-79 (June 1, 1979) and MARINA Memorandum Circular No. 72 (December 10, 1992).
Scope
- Applicable to the showing/exhibition of videograms onboard Philippine-registered passenger vessels operating in domestic trade.
- Specifies safety-related features that must be included in any film or videogram shown.
Definitions
- Videogram: Pre-recorded audiovisual material on video cassettes, discs, or similar media for projection or TV display; excludes video games and interactive software.
- Public Exhibition: Showing of videograms in onboard public or private places with monetary or promotional considerations or attendance of 15 or more persons.
- Commercial License: Authority issued to registered video establishments to produce, distribute, sell, rent or publicly exhibit videograms.
- Commercial Permit: Issued for commercial exploitation of videograms reviewed and classified by VRB.
- Credits: Pre-dubbed audio-visual markings of classification rating and VRB logo shown before and after the videogram.
- Rating Labels: Pre-printed classification marks such as General Patronage (G), Parental Guidance (P), Restricted (R) with VRB logo and monitoring number.
Policy Guidelines and General Provisions
- Films or videograms on shipboard safety must be approved by the Philippine Coast Guard (PCG) before showing.
- Safety videograms must include:
- Proper use of life jackets.
- Emergency alarms and public address announcements.
- Location of SOLAS equipment and firefighting systems.
- Information on mustering points, escape procedures, and passenger movement.
- Passenger actions during emergencies.
- Warnings about restricted/off-limit areas.
- Supervision of passengers.
- Security measures against unauthorized boarding, drug smuggling, pilferage.
- Crew-passenger socializing policies.
- Hygiene and sanitation standards in galley and passenger areas.
- Commercial videograms shown free to passengers must be approved, classified by VRB, and sourced from licensed outlets.
- Only videograms classified as General Patronage (G) may be shown publicly onboard.
- All copies must carry the VRB-mandated labels and credits identical to the master copy.
Responsibilities
- Vessel owner/operator, video exhibitor, and ship master are jointly liable for exhibitions of videograms not approved/classified by VRB.
- VRB representatives, with or without PCG escort, have unrestricted access to onboard exhibition areas for regulatory supervision.
- Coast Guard stations are tasked with monitoring compliance.
- Maritime Safety Office Commanders ensure safety videograms include mandatory features.
Penalties and Sanctions
- Commercial film violations are penalized under Section 21 of the VRB Revised Rules under PD 1987.
- Non-compliance with required safety film features results in:
- First offense: Fine of ₱1,000.
- Second offense: Fine of ₱2,000.
- Third and subsequent offenses: Fine of ₱5,000 and imprisonment up to six months.
- Ship master/video exhibitor is allowed one month to correct violations after imposition of administrative fines.
Effectivity
- This Memorandum Circular supplements MARINA Memorandum Circular No. 72 (Dec 10, 1992).
- Takes effect one month after publication in a newspaper of general circulation or 15 days after submission to the University of the Philippines Law Center.
