Law Summary
Background
- PNP through the Civil Security Group-Supervisory Office for Security and Investigation Agencies (CSG-SOSIA) recognizes the need to prevent bank and armored vehicle robberies.
- The Bank Security Management Association (BSMA) and Armored Security Association of the Philippines (ASAP) recommend operational procedures for incidents involving commercial armored vehicles.
Purpose
- To implement Standard Operating Procedures (SOPs) for managing commercial armored vehicles during traffic violations, accidents, and checkpoints.
- Aims include avoiding traffic congestion, prioritizing public safety, establishing operational security, and minimizing security risks for armored vehicles during such incidents.
Scope of Application
- Applies to commercial armored vehicles operated by Private Security Agencies (PSAs), Company Guard Forces (CGFs), and Government Guard Units (GGUs) providing services to banks and other financial institutions.
- Enforcement by the PNP in coordination with local government units.
Document and Identification Requirements
- Licensees/operators must ensure drivers carry two copies of the following for traffic violations and accidents:
- Certificate of Registration (CR)
- Official Receipt (OR)
- Insurance Policy
- Agency or appropriate officer’s calling card
- Driver’s license
- For checkpoints, required documents include:
- Duty Detail Order (DDO)
- Bank and Armored Guard License
- Firearm License
- Commercial armored vehicles must display identification markers (paint or sticker) with control numbers and approved color/design:
- Control Numbers 001-999 for BSMA
- Control Numbers 1000-9999 for ASAP
- Control Numbers 10000-10500 for Bangko Sentral ng Pilipinas (BSP)
Procedures for Traffic Accidents
- If the vehicle is loaded:
- Upon property damage, the driver must stop, explain urgency, hand over documents through the gun port, and proceed to the police traffic division to settle the case after delivery.
- For accidents involving death or serious injury, do not move vehicles; immediately attend to victims using other transportation.
- Call for police backup to secure the loaded vehicle during investigation.
- If the vehicle is not loaded:
- Settle matters immediately on site; provide documents and advise the other party to contact service company or bank.
Procedures for Traffic Violations
- For loaded commercial armored vehicles:
- Stop and hand over documents through the gun port without exiting.
- Politely explain the urgency to the traffic officer.
- Settle the traffic violation immediately after document delivery.
- For unloaded vehicles:
- Stop and submit to proper investigation.
- Police/traffic personnel must ensure the safety of the crew and vehicle during investigations.
Procedures during Checkpoints
- Drivers must pull over and communicate via the gun port.
- Hand over required documents listed previously.
- Officer in charge verifies documents, returns them, and allows safe passage.
Sanctions
- Violations of these SOPs may lead to criminal action.
- Providers found in breach are liable under Republic Act No. 5487, as amended, including its IRR provisions.
Repealing Clause
- All prior SOPs, circulars, memoranda, and directives that conflict with or are no longer applicable are rescinded.
Effectivity
- The SOP takes effect 15 days after filing with the University of the Philippines Law Center.
- This is pursuant to sections 3 and 4, Chapter 2, Book VII of Executive Order No. 292, known as the Revised Administrative Code of 1987.
