Law
Pnp Standard Operating Procedures No. 0125 - S2012
Decision Date
Jan 25, 2012
The Philippine National Police establishes comprehensive guidelines for handling vehicular accidents, traffic infractions, and checkpoints involving commercial armored vehicles to enhance public safety and operational security for financial institutions.

Legal basis and referenced instruments

  • Republic Act No. 5487 governs and is treated as the governing statute for liability under the SOP.
  • The SOP is to be implemented through the PNP Integrated Plan Against Bank Robbery/Armored Van Hold-Up.
  • The SOP draws procedures from the Joint Anti Bank Robbery Action Committee (JABRAC) Agreement.
  • The SOP is aligned with RA 5487 and its Implementing Rules and Regulations for purposes of sanctions.
  • The SOP references the Bank Security Management Association (BSMA) and the Armored Security Association of the Philippines (ASAP) as target hardening and coordination partners.

Policy, purpose, and operational intent

  • The SOP establishes procedures to discourage and prevent bank robbery and commercial armored vehicle hold-up attempts.
  • The SOP implements handling procedures for traffic violations, traffic accidents, and checkpoints involving commercial armored vehicles.
  • The SOP aims to avoid traffic jams during incidents involving commercial armored vehicles.
  • The SOP prioritizes public safety during traffic accidents involving commercial armored vehicles.
  • The SOP establishes operational security measures to ensure commercial armored vehicles are not exposed to risks during these situations.

Coverage: who and what is governed

  • The SOP applies to commercial armored vehicles deployed by Private Security Agencies (PSAs), Company Guard Forces (CGFs), and Government Guard Units (GGUs) providing armored vehicle guard services.
  • The SOP covers armored vehicle guard services provided to banks and other financial institutions.
  • The SOP is implemented by the Philippine National Police in coordination with local government units.
  • The SOP specifically addresses checkpoints involving the PNP/AFP.
  • The SOP applies to commercial armored vehicles used in contexts involving traffic violations, traffic accidents, and PNP/AFP checkpoints.

Documenting and identifying armored vehicles

  • Licensees/Operators/Owners must ensure the driver carries two sets of photocopies of specified documents in appropriate envelopes.
  • For traffic violations and accidents, the documents are: Certificate of Registration (CR), Official Receipt (OR), Insurance Policy, Calling Card of the Agency or Appropriate Officer, and Driver’s License.
  • For checkpoints, the documents are: Duty Detail Order (DDO), Bank and Armored Guard License, and Firearm’s License.
  • Licensees/Operators/Owners must post identification markers on covered commercial armored vehicles.
  • Covered commercial armored vehicles must have an identifiable marker with a control number and with the design, color, and location marking approved by both associations and concurred by the PNP through CSG-SOSIA.
  • Control number assignment is divided as follows: 001-999 for BSMA, 1000-9999 for ASAP, and 10000-10500 for BSP.
  • For identification marker coverage, the SOP includes commercial armored vehicles serving Bangko Sentral ng Pilipinas (BSP).

Traffic accidents: damage, injuries, and procedure

  • For accidents resulting in damage to property:
    • If the commercial armored vehicle is loaded, the driver must immediately stop, politely explain the urgency to proceed, and hand over the required documents through the gun port; the vehicle must then proceed to the Traffic Division/Section to settle the matter after delivery of the load.
    • If the commercial armored vehicle is not loaded, the driver must immediately stop and settle the matter with the other party by handing over the required documents and advising the other party to contact the armored vehicle service company and/or bank.
  • For accidents resulting in death or physical injuries:
    • For loaded commercial armored vehicles involved in a collision, the original position or final rest of the colliding vehicles should not be disturbed because it is indispensable in traffic investigation.
    • Because immediate medical attention is paramount, the crew must bring victim/s to the nearest hospital using any available means of transportation other than the involved commercial armored vehicle.
    • The commercial armored vehicle may be used to transport victim/s only if no other available vehicle exists.
    • The driver must immediately call for police back-up to secure the loaded commercial armored vehicle pending traffic investigation.

Traffic violations and checkpoint operations

  • For traffic violations when the commercial armored vehicle is loaded:
    • The driver must immediately stop and hand over the required documents to the traffic officer through the gun port without alighting/disembarking and must politely explain the urgency to proceed.
    • After delivery, the driver must immediately settle the traffic violation.
  • For traffic violations when the commercial armored vehicle is not loaded:
    • The driver must immediately stop and submit himself for proper investigation.
  • During traffic violation investigation, police/traffic personnel must ensure the safety of the crew and the commercial armored vehicle.
  • For PNP/AFP checkpoints:
    • When flagged, the driver should pull over, communicate through the gun port, and hand over the required documents.
    • After document completeness is checked, the officer in charge must return the documents and allow the safe passage of the commercial armored vehicle.

Liability, sanctions, and procedural reservation

  • Any PSA, CGF, or GGU commercial armored vehicle provider found violating any SOP provisions is held liable under Republic Act No. 5487, as amended.
  • Liability is enforced in accordance with RA No. 5487 and its Implementing Rules and Regulations.
  • Sanctions are applied without prejudice to the filing of applicable criminal action.

Rescission and effect of conflicting issuances

  • All SOPs, circulars, memoranda, and directives that are no longer applicable or that conflict with this SOP are rescinded.

Administration: adoption and filing mechanics

  • The SOP was adopted 25 January 2012.
  • The SOP requires filing a copy with the University of the Philippines Law Center as the trigger for the fifteen (15) days effectivity period.
