Policy, purpose, and coverage
- The guidelines govern the payment of registration fees for cooperatives.
- The guidelines apply to cooperatives registered under Republic Act No. 9520 (Section 1).
Key definitions for fee payment
- “Registration Fee” means the fee as prescribed by the Authority (Section 2[a]).
- “Full Payment” means the equivalent sum of money prescribed in the scheduled of fees of the Authority, payable in cash, Manageras Check, and other forms of payment acceptable to the National Government (Section 2[b]).
- “Non-Negotiability” means a post dated check is refused for negotiation by the depository bank of the Authority (Section 2[c]).
- “Post Dated Check” means a check that becomes payable and negotiable on a future date specified therein (Section 2[d]).
- “Payment by Installment” means a portion of the assessed registration fee divided into portions payable at different dates as provided in Section 5 (Section 2[e]).
- “Registration may be Nullified” means installment-based payment modes become void from the beginning, with effect only for the paid portion, which shall be forfeited in favor of the government (Section 2[f]).
Allowed payment modes and installment request
- The Authority applies two modes of payment of registration fees: (a) Full Payment and (b) Payment by Installment (Section 3).
- For Payment by Installment, the applicant cooperative must submit a Board of Directors Resolution requesting the Authority’s approval for installment payment (Section 3).
- The installment request must include:
- (1) a valid reason for inability to pay the full amount (Section 3(b.1)),
- (2) the assessed amount required to be paid (Section 3(b.2)), and
- (3) the schedule and mode of payment following Section 4 (Section 3(b.3)).
Fee thresholds and payment schedules
- 100,000.00 and below registration fees require Full payment upon registration (Section 4).
- For amounts above 100,000.01 up to 200,000.00, payment is payable within three (3) months (Section 4).
- For amounts above 200,000.01 up to 300,000.00, payment is payable within six (6) months (Section 4).
- For amounts above 300,000.01 up to 499,999.00, payment is payable within nine (9) months (Section 4).
- For amounts 500,000.01 and above, payment is payable within twelve (12) months (Section 4).
Approval process and payment mechanics
- Installment payment must be covered by post dated checks equally divided whether monthly or quarterly, as stated in the letter request (Section 5).
- The installment request is approved by:
- the Executive Director for applicants under the jurisdiction of the Central Office, or
- the Regional Director for applicants under the jurisdiction of the Extension Office (Section 5).
- The first payment must be made in cash or by a check dated on or before the issuance of the Certificate of Registration of amendments (Section 5).
- All payments must be made directly to the cashier of the concerned Extension Office/CO unit, using the corresponding Order of Payment (OP) (Section 5).
Custody, monitoring, and dishonor consequences
- The CDA Cashier acts as the custodian of post dated checks and monitors negotiability (Section 6).
- Once the post dated checks become negotiable, the Cashier coordinates with the Registration Division/Unit for issuance of the corresponding Order of Payment (Section 6).
Effect of a dishonored post dated check
- Any single post dated check found to be non-negotiable is treated as a waiver of the cooperative’s right over the total amount already paid (Section 7).
- The Certificate of Registration of amendments is deemed void ab initio for not having completed the registration requirement (Section 7).
- The cooperative must be notified within five (5) banking days after receiving notice of dishonor, to make payment arrangements (Section 7).
- If no arrangement is made, the cooperative’s registration may be nullified and the Authority must issue an Order nullifying the Certificate of Registration motu proprio (Section 7).
- The waiver and nullification consequences are without prejudice to:
- filing appropriate action under BP 22, and
- appropriate sanction under Article 140 of Republic Act No. 9520 for acts or omission of the cooperative and its officers (Section 7).
Effectivity and registration with ONAR
- The guidelines become effective upon approval by the Board of Administrators (Section 8).
- The guidelines take effect fifteen (15) days after registration with the Office of the National Administrative Register (ONAR) (Section 8).
