Scope and Application
- Guidelines apply to all agricultural and fisheries machinery pools, service centers, sales and distribution outlets, and manufacturing establishments, both public and private.
Definitions
- Agricultural and fisheries machinery and equipment include tractors, power tillers, seeders, transplanters, windmills, harvesting machines, irrigation systems, greenhouses, livestock and fishery equipment, slaughtering apparatus, processing machines, postharvest machines, transport machinery, and storage facilities.
- "Commission" refers to the Professional Regulation Commission (PRC).
- "Board" refers to the Professional Regulatory Board of Agricultural Engineering.
Required Manpower Complement
- At least one registered and licensed Agricultural Engineer must be employed in:
- Agricultural and fishery machinery service centers operated by registered cooperatives or businesses in Strategic Agricultural Development Zones (SAFDZs) or Agrarian Reform Communities (ARCs).
- Sales and distribution outlets of agricultural and fishery machinery and equipment.
- Machinery pools, service centers, common service facilities, processing centers managed by agricultural firms, cooperatives, government agencies, academic institutions, etc.
- Manufacturing or assembling establishments registered with SEC or DTI, including joint ventures.
- Employment may be on a full-time or part-time basis depending on professional service requirements.
Professional Services to be Provided
- Preparation and evaluation of project feasibility studies and technical specifications for machinery pools and service centers.
- Management and supervision of operation and maintenance activities within these centers.
- Training and supervision of machinery technicians and operators.
- Management and supervision of sales, distribution, assembly, and manufacturing activities, including design and technical specification preparation.
- Research and development aimed at improving operations and management of machinery-related facilities.
Qualifications
- Engaged Agricultural Engineers must hold valid, updated licenses issued by the PRC.
Compensation
- Salary and compensation should align with the Salary Standardization Law, the Labor Code of the Philippines, and prevailing professional fee rates.
Compliance Monitoring
- The Professional Regulation Commission and the Board will conduct inspections and monitoring to ensure compliance with these guidelines.
Sanctions and Penalties
- Violations of the guidelines will incur administrative and criminal penalties as provided under Section 31 and 32 of Republic Act No. 10601 and Section 32 of Republic Act No. 8559.
Separability Clause
- If any part of the guidelines is declared unconstitutional or invalid, other provisions remain effective and enforceable.
Effectivity
- The resolution takes effect fifteen (15) days after complete publication in the Official Gazette or a widely circulated newspaper.
- Copies are distributed to relevant government agencies, professional organizations, and private entities for information and implementation.
