Required Documents When Flagging Down a Vehicle

  • Upon stopping a motor vehicle, the driver must present:

    • Current Certificate of Public Convenience (CPC)
    • Confirmation Certificate (CC)

Reporting Requirements for LTO Enforcers

  • Enforcers must submit a Daily Apprehension Report (DAR) within 24 hours of any law enforcement activity during office hours.
  • The DAR must be received by the encoding section of the District Office (DO) or Operations Division.
  • Enforcers must also submit weekly reports for franchise-related violations under MC No. AVT-2014-1865.

Encoding Procedures

  • Apprehensions submitted from 8:00 AM to 12:00 NN must be encoded between 1:00 PM to 5:00 PM on the same day.
  • Apprehensions submitted after 5:00 PM must be encoded the following day between 8:00 AM to 12:00 NN.

Reporting Procedures for Deputized Agents

  • Deputized agents must transmit all Traffic Offense Reports (TOPs) within 24 hours from the date of apprehension to the District or Regional Office covering the geographical area of responsibility.

Completion and Content of Traffic Offense Reports (TOPs)

  • TOPs must be fully and accurately completed, including:
    • Details of the driver/operator and the motor vehicle
    • Date, time, and place of apprehension
    • Specific provision of law violated or the specific act/omission
    • Additional relevant data aiding in adjudication
  • No erasures, alterations, or cancellations of TOPs are allowed.

Lost TOP and Accountability

  • If a TOP is lost, the Enforcer must submit:
    • Affidavit of Loss
    • Police and/or Barangay Blotter
  • Accountability for lost TOPs remains with the Enforcer.

Consequences of Non-Compliance

  • Failure to follow the outlined procedures results in nullification of the apprehension.
  • Erring personnel are subject to disciplinary action, revocation of deputation, and possible criminal complaint filings.
  • TOPs are accountable forms; violations in their handling may lead to administrative actions.
  • Discrepancies discovered from post-audit of TOPs implicate the enforcing personnel personally, subjecting them to administrative and criminal proceedings.
