LTO Memorandum Circular No. AVT-2015-1922 establishes strict guidelines for law enforcement activities, requiring LTO Enforcers to wear official uniforms, properly document apprehensions, and submit reports within specified timeframes to ensure accountability and integrity in traffic law enforcement.

Core law-enforcement conduct rules

  • LTO Enforcers must at all times, when making an apprehension and while performing duties as such, wear their official uniform and official ID.
  • When flagging down a motor vehicle, the Enforcer must approach the motor vehicle and require the driver to present required documents.
  • For every apprehension involving a standard motor vehicle, the driver must present: Current Official Receipt (OR), Certificate of Registration (CR), and Driver’s License.
  • For For-Hire Vehicles, the driver must present, in addition to the documents required for a motor vehicle: Current Certificate of Public Convenience (CPC), Confirmation Certificate (CC), and Franchise Decision.

Required reporting and encoding timelines

  • LTO Enforcers must submit a Daily Apprehension Report (DAR) after law enforcement activity.
  • The DAR must be duly received by the encoding section of either the DO or the Operations Division.
  • The DAR must be submitted within twenty four (24) hours (office hours) immediately after any law enforcement activity.
  • LTO Enforcers must submit a weekly report for franchise related violations under MC No. AVT-2014-1865.

Encoding and transmission instructions

  • For LTO Enforcers, apprehensions submitted in the morning (8:00am–12:00nn) must be encoded in the afternoon (1:00pm–5:00pm).
  • For LTO Enforcers, apprehensions submitted in the afternoon (5:00pm onwards) must be encoded in the morning (8:00am to 12:00nn) of the following day.
  • For other deputized agents, TOPs must be transmitted within twenty four (24) hours from the date of apprehension to the District Offices or Regional Office having the geographical area of responsibility (GAOR).

TOP form completion and handling

  • All Enforcers are strictly directed to completely fill-up the TOP.
  • The TOP must state all required data relative to the driver/operator and the motor vehicle involved, including date, time, and place of apprehension.
  • The TOP must state the provision of law violated and/or the specific act or omission.
  • The TOP must include all other data necessary that may help in effective and immediate adjudication of the apprehension case.
  • No erasures/alterations and cancellation of TOP are allowed.

Lost TOP documentation requirement

  • If a TOP is claimed as lost by the Enforcer, the lost-TOP claim must be supported by an Affidavit of Loss and Police and/or Barangay Blotter.
  • Submission of the Affidavit of Loss and blotter is made without prejudice to the Enforcer’s accountability.

Consequences for non-compliance

  • Failure to observe the required procedures results in nullification of the apprehension.
  • Erring personnel are subject to appropriate disciplinary action and/or revocation of the deputation order, without prejudice to filing appropriate criminal complaint/s.
  • The TOP is an accountable form, and violations of the guidelines regarding accomplishment, reporting/endorsement, and encoding of cited violations are a sufficient ground for administrative action.
  • Any discrepancy found through post-audit of the TOPs creates personal liability of the Enforcer concerned, without prejudice to any administrative action and criminal case against the Enforcer.
  • The circular directs strict and immediate compliance by addressees.
