Policy, purpose, and framework
- The guidelines are issued in line with Department Order Nos. 3 and 3-A Series of 1994 on Training, Testing, Certification and Deployment of Performing Artists.
- The Artist Record Book (ARB) serves as proof of a performing artist’s competence for the job indicated in the ARB.
- The interim requirement of a booking confirmation from a foreign employer/promoter and licensed agency is imposed to control the number of applicants during the onset of the new system.
- The ARB is used as a gating requirement for POEA processing related to overseas deployment and related clearances.
Artist Record Book: what it is
- The Artist Record Book (ARB) is issued to a performing artist.
- The ARB attests to the artist’s competence for the job indicated in the ARB.
- The ARB must contain information on the artist’s training, academic and skills test, and overseas employment history.
- The ARB must indicate the artist’s personal data.
Who may receive the ARB
- A performing artist who has been granted a Competency Certificate by the NMYC is eligible for issuance of an ARB.
- At the onset of the new system, the POEA requires an applicant for an ARB to be in possession of a booking confirmation from a foreign employer/promoter and licensed agency.
- The booking confirmation requirement applies only on an interim basis to control the number of applicants.
- Artists who are granted exemption from the academic and skills tests by the Secretary of Labor and Employment and possess a booking confirmation or employment contracts may be issued an ARB.
ARB issuance procedure and fees
- For every Artist eligible for an ARB, the NMYC must transmit to the Employment Branch of the POEA:
- Academic and Skills Training Certificates.
- A Performing Artist Information Sheet duly certified as true and correct by the Artist and Training Center.
- 2 pcs. 2 x 2 colored picture of Artist.
- The NMYC transmittal must indicate the date of personal appearance by the artist at the POEA.
- The performing artist must present to the POEA the original copy of the Certificate of Competency and the Booking Confirmation (the interim requirement).
- The artist must be assessed an ARB fee of P300.
- After the POEA finds all enumerated documents in order and after the artist pays the ARB fee, the POEA assigns an ARB by affixing the artist’s signature and left and right thumbmarks in the presence of the POEA.
- After ARB issuance, the artist must be notified of ARB approval and informed that the ARB is released to the licensed agency only after the employment contract is approved by the POEA.
- When a licensed agency presents the artist’s Employment Contract, Certificate of Eligibility, and RFP (Request for Processing), the Employment Contract Processing Branch receives the endorsement from the Employment Branch of the artist’s ARB and booking confirmation.
- The POEA must furnish the NMYC and the EIAC with a period list of artists issued ARBs.
How the ARB must be used
- The POEA processes only an artist with a valid ARB for deployment.
- Submission of the ARB is required for:
- Processing the artist’s employment contract.
- The pre-departure showcase preview of group performers.
- Exit clearances at NAIA and other exit points.
- When an artist transfers to another management entity, the ARB becomes valid for contract processing after it is amended by POEA upon submission of a clearance from the training center or licensed agency which originally endorsed the ARB application.
- The required clearance must be issued not later than 30 days from notice.
ARB validity and grounds for suspension or cancellation
- The ARB has a three-year validity period.
- The POEA may suspend or cancel an ARB for any of these reasons:
- Falsification of requisite documents or false statements in connection with the ARB application.
- Acquisition of a second ARB without declaring and/or surrendering the first ARB issued to the POEA.
- Tampering with the ARB.
- Using the ARB for activities and purposes violative of the POEA Rules and Regulations Governing Overseas Employment.
- In addition to suspension or cancellation, parties found to have contributed to the cause(s) are subject to being placed in the POEA watchlist or blacklist or to sanctions under the Schedule of Penalties for licensed agencies and authorized training centers.
- The POEA must provide the FIAC, NMYC, authorized training centers, and licensed agencies with lists of suspended/canceled ARBs and watchlisted/blacklisted individuals.
Capability build-up and mandatory start date
- During a capability build-up phase proceeding from 15 April 1994, private sector training centers and testing venues establish required facilities and staff.
- The ARB is a mandatory requirement for contract processing beginning 1st October 1994.
- The order directs guidance and strict compliance by all concerned.
