- Approved plan: A survey plan verified and approved by the DENR, showing land boundaries and details.
- CENR Office: Community Environment and Natural Resources Office or equivalent.
- CHED: Commission on Higher Education.
- DepEd: Department of Education.
- PENR Office: Provincial Environment and Natural Resources Office.
- Public use/purpose: Use of land exclusively by the government for public services and structures accessible to the public.
- Special Patent: A government-issued document confirming State grant of ownership over alienable and disposable agricultural land.
Beneficiaries of Special Patent for Public School Sites
- Special Patents issued in the name of the Republic of the Philippines, Department of Education, and the specific school for DepEd sites.
- For CHED sites, titles issued in the name of the School and the Republic of the Philippines.
Authorized Requestors for Special Patent Issuance
- Superintendent of the Division of Schools or authorized DepEd Central Office officials.
- Authorized officers of CHED or the respective higher education institution.
Documentary Requirements for Requesting Special Patents
- Request letter from authorized officials.
- Historical possession/occupation background.
- Recent panoramic photographs of the site and surroundings.
- Certification from the Regional Trial Court or Land Registration Authority of no pending land registration applications.
- For DENR: Approved cadastral map or survey plan, technical description, and certification of agricultural classification.
Procedure for Processing Special Patent Requests
- Filing at the appropriate CENR Office (or implementing PENR Office). In NCR, filed at DENR NCR Regional Office.
- Posting of notices for 15 days at municipal/city hall, barangay hall, and the school premises.
- CENR Office processes requests within 120 days from filing, including verification period.
- Survey authority issued if there is no approved survey; survey period excluded from 120 days.
- Land investigator conducts ocular inspection and verification of land's eligibility and use.
- Oppositions only entertained based on valid Certificates of Title; frivolous claims rejected.
- Alternative dispute resolution (ADR) encouraged for opposition resolution; 30-day limit to resolve oppositions.
- Upon CENR approval, documents forwarded to PENR Officer for approval within 5 days.
- Disapproved requests may be re-filed.
Special Patent Numbering System
- Unique number assigned by PENR Office upon approval.
- Format: SP-Sch-[3-letter province code]-[4-digit sequential number].
- Example: SP-Sch-ABR-0001 for first patent in Abra province.
Handling of Pending Applications
- Pending Special Patent applications or land proclamations for educational use automatically converted to requests under RA 10023, unless disqualified.
- Existing documentary requirements used as much as possible.
- Applications under review in DENR offices forwarded to appropriate CENRO or PENRO for compliance.
- Requesting parties notified of new procedures.
Transmittal and Registration of Approved Special Patents
- PENR Officer transmits approved patent to Registry of Deeds for registration.
- Requesting party informed and bears expenses for registration, including duplicates and Land Management Bureau copies.
Monitoring
- PENR Office forwards copy of processed requests to Land Management Bureau for monitoring and recording.
Separability Clause
- Invalidity of any provision does not affect other sections which remain effective.
Repealing Clause
- Repeals or modifies all inconsistent prior issuances.
Effectivity
- Order takes effect 15 days after publication in a newspaper of general circulation and upon receipt by the Office of the National Administrative Register (ONAR).
