Objectives
- Provide guidance and assistance to LGUs for implementing Sections 7 and 8 of R.A. 7279.
Scope
- Inventory covers all lands and identification of suitable sites for socialized housing in urban and urbanizable areas.
- Lands included: undeveloped/vacant residential lands approved by HLURB; government-owned lands; unregistered, abandoned, or idle lands; lands outside zoned built-up areas suitable for housing; squatter settlements; marginal agricultural lands eligible under DAR criteria; government lands unused for 10 years.
- Lands excluded (but mapped): lands under CARP, defense/security lands, lands used for government offices or installations unless unused for 10 years, areas for environmental protection, religious/charitable/educational sites, hospitals, cemeteries.
Definitions
- Areas for Priority Development (APD): Declared areas under relevant laws and orders.
- Blighted Lands: Dilapidated, unsanitary areas inhibiting development.
- Idle Lands: Non-agricultural lands without improvements certified by assessors.
- Improvements: Structures and fixed constructions valued at least 50% of assessed property value.
- Government Lands: Owned or controlled by national government or entities.
- Marginal Lands: Poorly productive lands due to topography or poor yields.
- Resettlement Areas: Identified sites for relocation of underprivileged and homeless.
- SIR and ZIP Programs: National Housing Authority initiatives for slum upgrading inside and outside Metro Manila.
- Socialized Housing: Government or private programs for housing underprivileged and homeless including ancillary services.
- Underprivileged and Homeless: Individuals/families below poverty threshold lacking housing ownership and security of tenure.
- Unregistered/Abandoned Lands: Lands without registration or productive use for 3 years, excluding cases of force majeure.
- Urban and Urbanizable Areas: Defined by population density and potential for urbanization within 5 years.
Responsible Agencies and Roles
- LGUs: Conduct inventory and identify socialized housing sites.
- HLURB: Provide guidelines, training, technical assistance, and land use data.
- NAMRIA: Supply base maps, aerial photos, and cartographic materials.
- LMB: Provide cadastral maps and government lands inventory.
- NHA: Provide identification guidelines, accept title documents, assist in program implementation.
- Other agencies providing data include BIR (land valuation), DA/BSWM (agricultural areas), DAR (agrarian lands), DENR/EMB (environmental areas), DOTC (transport), NSO (population), NPC/Meralco/NEA (power), MWSS/LWUA (water), DPWH (roads), and local assessor offices.
General Guidelines and Methodology
- LGUs to inventory all lands assessing land use, basic services, and suitability using methodologies such as ocular inspection, aerial photo and Landsat analysis, tax and cadastral maps, and community interviews.
- Documentation to include: base maps, maps of suitable sites, assessed values, land use/zoning, and basic services.
- Inventory reports to be submitted to HUDCC.
Site Selection Criteria
- Sites should:
- Preferably be near employment opportunities.
- Have existing or quickly accessible basic services and facilities.
- Provide affordable transport costs.
- Require minimal land modification and exclude steep or weak soil areas.
- Avoid environmentally critical areas.
- Be compatible with existing zoning.
- Be financially viable with low land valuation.
- Have clear tenurial status.
Prioritization for Site Selection
- Priority lands include:
- Government-owned lands.
- Alienable public domain.
- Unregistered, abandoned, or idle lands.
- Declared APDs, ZIP, and SIR sites not yet acquired.
- BLISS sites not yet acquired.
- Privately-owned lands.
Completion and Updating of Inventory
- Inventory to be completed within one year of guideline effectivity.
- Updates to be done every three years.
- LGUs must furnish copies to HUDCC.
Turnover of Government Lands
- Public lands unused for 10 years and deemed suitable shall be transferred to the NHA with Presidential approval.
Zonification of Identified Sites
- Sites must be in residential zones per LGU zoning ordinances approved by HLURB.
- Sites not within residential zones must be within priority sites and meet suitability criteria.
- Identified sites to be zoned as SOCIALIZED HOUSING ZONES.
- Current zoning ordinances to be reviewed and revised accordingly.
Supplementary and Interpretative Rules
- HLURB Chief Executive Officer authorized to issue supplemental rules, interpretative policies, and procedural guidelines for inventory implementation.
Separability and Effectivity
- If any part declared contrary to law, the remainder remains effective.
- Guidelines become effective immediately upon approval.
Inventory Documentation Forms
- Detailed forms for inventory capturing TCT number, ownership, area, location, classification, assessed value, land use, zoning classification, and availability of basic services.
- Summary forms for aggregated data per classification and area in hectares.
