Guidelines for apprehending "colorum" public utility vehicles and for-hire motor vehicles with expired Certificates of Public Convenience are established to prevent losses for legitimate operators and ensure compliance with regulatory requirements.

Required Documents During Apprehension

  • Driver/operator must present:
    • Copy of the Petition for Extension of Validity of CPC duly received by the LTFRB.
    • Official Receipt acknowledging the petition.
    • The expired franchise document.
  • No apprehension shall be made if these documents are properly presented at the time of apprehension.

Consequences of Failing to Present Required Documents

  • Immediate apprehension of the vehicle and driver/operator for colorum operation.
  • The unit shall be impounded pending further adjudication.

Procedures During Adjudication

  • If the prescribed documents are presented during adjudication:
    • A fine of Three Hundred Seventy Five Pesos (P375.00) for "No CPC Carried" violation.
    • A Ten Pesos (P10.00) Legal Research Fund fee.
  • If documents are not presented at adjudication:
    • A fine for colorum operation shall be imposed.

Release of Impounded Vehicles or Items

  • Confiscated or impounded vehicles or objects shall not be released without prior verification of documents from LTFRB or the concerned Regional Director.

Reporting and Coordination

  • The Land Transportation Office (LTO) must furnish a copy of the Adjudication Resolution finding a colorum violation to the LTFRB Chairperson or concerned Regional Director.
  • The report should include the imposed fine/penalty and request appropriate action in response to the violation.

Superseding Effect and Compliance

  • All prior orders, memoranda, or circulars inconsistent with these guidelines are superseded and modified accordingly.
  • Strict compliance with these guidelines is mandated for all concerned authorities.

Adoption and Authority

  • These guidelines were adopted on March 3, 2005.
  • Signed by Assistant Secretary Anneli R. Lontoc for official implementation.
