Establishment of Deputation Evaluation Committee (DEC)
- DEC operates under the Office of the Assistant Secretary in accordance with R.A. No. 4136.
- Responsible for evaluating all deputation applications.
- All previous deputation orders issued by Regional Directors cancelled effective June 30, 2009.
- Assistant Secretary acts on all applications for deputation.
- Regional Directors recommend qualified applicants and supervise deputized agents in their areas.
Qualifications of Deputized Agents
- Must be:
- Civilian government employees in permanent positions directly related to traffic law enforcement.
- Members of AFP/PNP with duties directly related to traffic enforcement.
- Other government employees deemed capable by the Assistant Secretary to enforce R.A. No. 4136 and related laws.
Procedure for Application
- Submission to DEC includes:
- Certified photocopy of Certificate of Employment or appointment contract.
- Endorsed application form by Head of Office.
- Two signed 2x2 photographs.
- Applicants must attend a Deputation Seminar covering:
- Relevant land transportation laws (e.g., R.A. 4136, Public Service Act).
- Apprehension procedures.
- Filipino values and law enforcement responsibilities.
- Overview of LTO and other agencies.
- Traffic direction and control.
- Life saving and first aid techniques.
- Applicable Civil Service laws.
- Regional Directors arrange training and examination.
- Traffic Safety Division conducts training with regional office staff.
Maintenance of Records
- DEC Secretariat maintains records including:
- List of deputized agents.
- Applications, orders, IDs, TOP booklets.
- Other relevant documentation.
Ground for Revocation of Deputation
- Offenses or causes include:
- Discourteous conduct, extortion, negligence, insubordination.
- Grave misconduct, abuse of authority.
- Incompetence, inefficiency, corruption.
- Failure to submit apprehension reports timely.
- Offenses involving moral turpitude, separation from service.
- Dishonesty, death.
Revocation Procedure
- Written complaints filed to DEC or Regional Director.
- Central Office forwards complaints to DEC for action.
- Internal Affairs Unit assists in investigation.
- Assistant Secretary may suspend deputized agents pending investigation.
- Notice served to accused; DEC may proceed ex parte if no appearance.
- DEC findings require Assistant Secretary approval.
- Upon revocation, deputation ID and TOP must be surrendered.
- Assistant Secretary may independently revoke, cancel, or suspend deputation.
Disqualification for Non-Compliance
- Failure to surrender deputation materials disqualifies previous agents from reapplication.
- They may face penalties under other applicable laws.
Repealing Clause
- All prior conflicting orders or memoranda are repealed.
