Qualifications for Permanent Residency
- Filipino WWII veterans with U.S. citizenship acquired under the 1990 Immigration Act qualify.
- Rights automatically accrue to spouses and qualifying children upon proper application.
Application Procedures
- Qualified individuals residing abroad must meet Philippine reentry requirements.
- Upon entry, applicants may obtain permanent resident status from Bureau of Immigration and Deportation.
- Veterans in the Philippines who obtained U.S. citizenship via the U.S. Embassy can apply similarly.
Documentary Requirements
- Applicants must present U.S. passports and proof of Filipino citizenship (birth or baptismal certificates, or equivalent).
- Other regular requirements by law or Bureau of Immigration are waived.
Land Ownership Rights
- Veterans and qualified family members may retain land acquired prior to U.S. citizenship.
- If no prior land ownership, eligible to acquire one residential lot (up to 1,000 square meters) and/or one farm lot (up to 3 hectares).
- Ownership subject to existing Philippine laws.
Right to Practice Profession
- Qualified veterans and family members are entitled to practice their profession in the Philippines despite U.S. citizenship.
Additional Privileges
- Exemption from registration and immigration fees after complying with Alien Registration Law.
- Multiple-entry visa valid for two years granted.
- Reentry permit valid for two years available from the Bureau of Immigration and Deportation.
- Immunity from deportation unless convicted of crimes against the State and permanent resident status is cancelled.
- Rights to retain ownership of shares and properties acquired as Filipino citizens prior to U.S. citizenship.
Implementation Mechanism
- Commissioner of Immigration required to issue implementing rules and regulations within 30 days from effectivity.
- Establishment of registration centers by Bureau of Immigration and Deportation to facilitate implementation.
Legal and Procedural Clauses
- Repealed or modified laws, decrees, or orders inconsistent with this Act.
- Separability clause ensures that invalidity of one provision does not affect others.
- The Act takes effect 15 days after publication in two national newspapers.
