Purpose and humanitarian basis
- The decree recognizes that there is a substantial number of aliens in the Philippines who entered as non-immigrants and many have married and borne families in the Philippines.
- The decree acknowledges that Presidential Decree No. 419 allows certain non-immigrant aliens to acquire permanent residence without the need for visas abroad under paragraph 2, section 9 of the “present Immigration Act,” but still requires them to apply for immigrant visas with the Commission on Immigration and Deportation.
- The decree states that many of the covered aliens have already been screened and found qualified for permanent residence by the National Intelligence Security Authority of the Philippines.
- The decree declares the need, for humanitarian consideration, to grant these aliens permanent residence in the Philippines.
Authority to grant permanent residence
- Permanent residence is granted by the President to certain alien non-immigrants now in the Philippines who are included in the attached list.
- Coverage is limited to those who have already been screened and found qualified for permanent residence by the National Intelligence Security Authority of the Philippines.
- The grant is made by the decree without requiring further visa action under the situation described in the decree’s recitals regarding Presidential Decree No. 419 and the Commission on Immigration and Deportation.
Covered persons and eligibility condition
- The beneficiaries are aliens who are now in the Philippines as nonimmigrants.
- Eligibility requires prior screening and qualification by the National Intelligence Security Authority of the Philippines.
- The attached list is titled “LIST OF ALIEN NON-IMMIGRANTS (CHINESE) RECOMMENDED FOR PERMANENT RESIDENCE UNDER PRESIDENTIAL DECREE NO. 730.”
- Beneficiaries are identified by name and an ACR No. in the attached list.
Effectivity rule
- Presidential Decree No. 730 takes effect immediately upon issuance.

- The operative beneficiaries are those enumerated in the attached list of alien non-immigrants (Chinese) recommended for permanent residence under Presidential Decree No. 730.
- Each listed alien is identified using name and an ACR No.
