Duration and Conditions of the Temporary Permit
- The permit remains valid only while the Government has not established similar radio communication services in the grantee’s chosen locations.
- Construction or installation must begin within one year from the Act’s approval date and be completed within two years to prevent the permit from becoming void.
Restriction on Commercial Telecommunications Business
- The grantee, successors, or assigns are prohibited from engaging in the domestic telecommunications business without further special congressional approval.
- The permit strictly allows the construction and operation of radio stations for communication relevant to the grantee’s agricultural or industrial interests.
Scope of Communications and Prohibition on Fees
- No fees may be charged for communication services conducted through these radio stations.
- The stations must be used exclusively for the grantee’s business-related communications.
Interference and Operational Requirements
- The grantee must operate the stations to avoid interference with other radio stations in the Philippines.
Indemnification of Government
- The grantee shall hold all levels of Philippine government harmless from any claims or damages resulting from accidents or injuries caused by the radio stations’ construction or operation.
Frequency Authorization
- The grantee is authorized to operate on medium frequency, high frequency, and very high frequency bands assigned by the Secretary of Public Works and Communications.
Presidential Authority in Exceptional Circumstances
- The President of the Philippines may order the closure or temporary government use of the grantee's radio stations during war, insurrection, public peril, calamity, or disaster.
- Just compensation must be provided for any temporary use or possession of the stations by the government.
Non-Transferability and Congressional Control
- The temporary permit cannot be transferred or alienated without prior congressional consent.
- Congress holds the power to amend, alter, or repeal the permit, especially when public interest necessitates.
- This permit is not an exclusive privilege.
Effectivity of the Act
- The Act became effective immediately upon approval on June 12, 1956.
