Manufacture and Pricing of Ice
- The grantee is required to manufacture and supply ice up to the plant's full capacity.
- The Public Service Commission determines the limit of the plant’s capacity.
- Ice sales prices shall be regulated and fixed by the Public Service Commission.
Equipment Standards and Upkeep
- All equipment and appurtenances used must be modern, safe, and of first-class quality.
- The grantee must comply with orders from the Public Service Commission to upgrade or replace equipment if public interest so demands.
- The grantee bears all expenses related to such changes or alterations.
Commencement of Construction and Conditions for Franchise Validity
- Construction of the ice plant and cold storage must begin within one year from the law’s approval.
- Exceptions apply if delay is caused by acts of God, force majeure, martial law, riot, civil commotion, usurpation by military power, or other uncontrollable circumstances.
- Failure to commence construction within the specified period renders the franchise null and void.
Congressional Authority to Amend or Repeal
- The franchise is subject to amendment, alteration, or repeal by the Congress of the Philippines.
- Such actions may be taken when public interest requires.
Transparency and Reporting Requirements
- The grantee’s books, records, and accounts must be accessible for inspection by the Auditor General or authorized representatives at all times.
- The grantee must submit quarterly reports in duplicate to the Auditor General detailing gross receipts for the previous quarter.
Equalization of Franchise Terms in Case of Competition
- If any competing franchise granted by Congress contains more favorable terms, those terms become automatically incorporated into this franchise.
- This clause ensures the grantee is not disadvantaged compared to competitors.
Effectivity of the Act
- The law takes effect immediately upon its approval.
- The act was enacted without the Executive’s approval on June 17, 1967.
