Exclusions and Disqualifications from Amnesty

  • Excludes individuals who promoted or led rebellion or insurrection.
  • Excludes public officials/employees who engaged in rebellion while in office.
  • Excludes those who committed grave crimes: murder, homicide, serious physical injuries, crimes against chastity, robbery, piracy, arson, hijacking, violations of firearms/explosives laws.
  • Persons who merely participated or acted under orders in a rebellion may still be granted amnesty.
  • Crimes committed in furtherance of subversion may be excused if committed by mere affiliates or participants.

Application Requirements and Conditions

  • Application deadline: December 31, 1977.
  • Applicant must take an oath of allegiance to the Republic of the Philippines.
  • Applicant must swear to support and defend the Philippine Constitution.
  • Mandatory surrender of any unlicensed firearms, explosives, and ammunition.

Amnesty Commissions and Their Roles

  • Existing Amnesty Commissions under Presidential Decree No. 124, as amended, will handle applications.
  • Commissions have authority to examine facts, conduct summary hearings, and require official records.
  • Recommendations are submitted to the President through the First Amnesty Commission for review.

Criminal Proceedings and Suspension

  • Investigation and trials of criminal cases against applicants continue unless directed otherwise by the President or Secretary of National Defense.

Compensation for Amnesty Commission Members

  • Traveling expenses and a daily allowance of PHP 150 for commission members when performing duties.
  • Expenses charged to the Command for Administration of Detainees.

Implementation Rules and Regulations

  • Rules from Presidential Decree No. 124 apply unless inconsistent with this Decree.
  • Secretaries of Justice and National Defense can jointly issue implementing rules as necessary.

Repeal of Conflicting Laws

  • All laws, decrees, orders, and regulations inconsistent with this Decree are rescinded or modified accordingly.

Effectivity of the Decree

  • The Decree takes effect after two consecutive weekly publications in at least two newspapers of general circulation in the Philippines.
