Restrictions on Advertising in Printed Media
- It is unlawful to insert or cause to be inserted any advertising in newspapers, books, or periodicals printed in the Philippines that misrepresents the character, value, properties, or condition of the article advertised.
- This applies regardless of the nature or form of the article or its constituent materials.
Prohibitions in Various Other Advertising Mediums
- The law extends prohibitions against misrepresenting any article’s character, value, properties, or condition to any other form of advertising.
- This includes handbills, billboards, signs, pamphlets, circulars, projected lantern slides, or any other printed, displayed, or circulated advertising forms within the Philippines.
Misrepresentation of Stocks, Bonds, and Corporate Shares
- It is forbidden to misrepresent the character or value of stocks, bonds, shares, or the properties and prospects of any firm or corporation.
- These misrepresentations in advertising, regardless of medium, are unlawful within the Philippines.
Use of Postal Services for Prohibited Advertising
- The use of the Philippine postal system to circulate advertising matter prohibited by this Act is unlawful.
- However, this Act does not prohibit the sale or delivery through the mails of standard books, magazines, or periodicals published abroad.
- The Act’s provisions apply fully to publications used for promoting the sale of merchandise, stocks, bonds, shares by any person, firm, or corporation.
Penalties for Violation
- Violators of any provisions of this Act are subject to penalties upon conviction.
- Penalties include a fine not exceeding five thousand pesos, imprisonment for up to six months, or both, at the court’s discretion.
Effectivity
- This Act takes effect six months after its approval date.
