Legal basis and covered claims
- These guidelines are implemented for claims for benefits under Republic Act No. 6948.
- The guidelines apply in processing and adjudication of claims under Republic Act No. 6948 filed by:
- Filipino citizens who served in allied forces; and
- Foreign nationals who served in the Philippine Army and guerrilla organizations during World War II.
- These guidelines expressly align eligibility principles with Section 2(a) of Republic Act No. 6948 and Section 2(a) of DND Department Order Number A-049.
- Section 4 of Republic Act No. 6948 is treated as recognizing the period 8 December 1941 to 3 July 1946 as the duration of World War II military operations in the Philippines.
WWII effective period and official campaign endpoints
- The effective period of World War II in the Philippines is from 8 December 1941 to 3 July 1946.
- The forces of the Commonwealth of the Philippines are recognized as officially concluding the Philippine Liberation Campaign on 3 September 1945 (referenced as Paragraph 19(g), AFPR G 131-052).
- The forces of the United States of America are recognized as officially concluding the Asiatic-Pacific Campaign on 2 March 1946 (referenced as Paragraph 19(i), AFPR G 131-052).
- The guidelines instruct that Section 4 of Republic Act No. 6948 governs for eligibility purposes by recognizing 8 December 1941 to 3 July 1946 as the duration of World War II military operations in the Philippines.
Definitions of qualifying veterans’ service categories
- Under these guidelines, persons who served within Philippine territorial limits between 8 December 1941 and 3 July 1946 are considered World War II veterans, consistent with Section 2(a) of Republic Act No. 6948 and Section 2(a) of DND Department Order Number A-049.
- A Filipino citizen qualifies as a World War II veteran when serving in the military service of allied forces, including:
- Old Philippine Scouts;
- New Philippine Scouts;
- United States Army;
- United States Navy;
- United States Marine Corps; and
- other friendly foreign forces.
- A foreign national qualifies as a World War II veteran when serving in the military service of:
- the Philippine Army; or
- guerrilla organizations recognized by the Republic of the Philippines.
- Eligibility under these categories is anchored on service rendered within Philippine territorial limits during the period 8 December 1941 to 3 July 1946.
Coverage rules for eligibility and disqualification by duplication
- The veterans referred to in the qualifying categories and their dependents are eligible for benefits under Republic Act No. 6948, subject to other requirements.
- Eligibility applies for “certain benefits” under Republic Act No. 6948 for the qualifying veterans and their dependents.
- Eligibility is conditioned on the absence of duplication of similar benefits:
- Veterans and dependents are not eligible if they have received or are receiving similar benefits for the same considerations from other government funds or from the United States Government.
Benefit-specific service requirements and exclusions
- Educational Benefits (foreign nationals): A foreign national who served in the Philippine Army or in a recognized guerrilla organization must have entitlement computed in accordance with Section 15 of DND Department Order Number A-049.
- Educational Benefits (Filipino citizens): A Filipino citizen who served in an allied unit within Philippine territorial limits is not eligible for educational benefit.
- Disability Pension (foreign nationals): A foreign national veteran must have been disabled owing to sickness, disease, wounds or injuries sustained in line of duty within Philippine territorial limits during 8 December 1941 to 3 July 1946.
- Disability Pension (Filipino citizens): A Filipino citizen who served in an allied unit within Philippine territorial limits is not eligible for disability pension.
- Death Pension: A veteran must have died in line of duty within Philippine territorial limits during 8 December 1941 to 3 July 1946, or must have died at any time after departure from Philippine territory or after honorable separation from service, as a result of:
- wounds or injury received; or
- sickness or disease incurred;
- in line of duty within Philippine territorial limits during 8 December 1941 to 3 July 1946, or as a consequence of the performance of such duty.
- Old Age Pension, Hospitalization and Burial Benefits: A veteran must have:
- participated in any engagement against the enemy; or
- completed thirty (30) days of continuous service or sixty cumulative days of broken service within Philippine territorial limits during the period 8 December 1941 to 3 July 1946.
Supersession of earlier guidelines
- A corrected copy of Supplementary Guidelines No. 90-5 supersedes the Supplementary Guidelines issued on 8 August 1990.
