Legal basis and purpose
- Republic Act No. 6425 (as amended) vests the Dangerous Drugs Board with authority under Section 36(a) to issue rules.
- The regulation is issued to implement the last sentence of Section 25(b) of Republic Act No. 6425.
- The regulation sets rules to govern how dangerous drug prescriptions are filled by drugstores, using specific labeling markings.
Core rule on filling prescriptions
- Whenever a prescription for dangerous drugs is filled by a drugstore, the drugstore owner must perform stamping requirements.
- If the full quantity stated in the prescription is sold, the drugstore owner must stamp the words "USED IN FULL" in bold prints diagonally across the original copy of the prescription.
- If the quantity stated in the prescription is not fully sold, the drugstore owner must stamp the words "USED FOR _______ ONLY" and indicate the number of tablets, capsules, etc. actually sold.
- The stamping must be done across the original copy of the prescription in the filling process.
Enforcement consequence for violations
- Section 2 provides that violation of the regulation is a ground for disauthorizing the drugstore concerned to sell dangerous drugs.
Date of adoption and immediate implementation
- Section 3 states that the regulation takes effect immediately upon issuance.
- The regulation’s adoption is 31 July 1973 under the signature of Clemente S. Gaimaitan, M.D., M.P.H. as Chairman.
