Absence of Specified Fee and Establishment of Fees by the Board
- The original rules did not specify the amount of filing fees required.
- The Board, under its powers granted by Section 5(i) of Executive Order No. 202 (June 19, 1987), promulgated a policy to regulate the filing fees to be charged.
Filing Fees for Complaints Between Operators
- Complaints filed by one operator against another operator must be accompanied by a filing fee of P420.00 per complaint.
Exemption from Filing Fees
- Complaints filed by the public against operators for violations of the Public Service Law, related rules and regulations, and terms and conditions of the CPC are exempt from any filing fees.
- Likewise, complaints filed by the Republic of the Philippines and its instrumentalities and agencies against operators are exempt from payment of filing fees.
Authority and Effectivity
- This Memorandum Circular was issued pursuant to Presidential Memorandum Circular No. 11 dated December 9, 1992.
- It took effect fifteen (15) days after its filing with the University of the Philippines Law Center.
- The Circular supersedes any contradictory provision found in previous Memorandum Circulars or Board Rules and Regulations regarding filing fees.
