Eligibility Criteria for Entry

  • The alien must be entitled to enter the Philippines under a treaty of commerce and navigation.
  • Entry is permitted solely for two purposes:
    1. To carry on substantial trade principally between the Philippines and the alien's country of nationality.
    2. To develop and direct the operations of an enterprise in which the alien has invested or is actively investing a substantial amount of capital in accordance with the Philippine Constitution and laws.

Family Members Eligible for Entry

  • The alien’s wife and unmarried children under twenty-one years of age may accompany or follow to join the alien in the Philippines.

Reciprocity Condition

  • The entry privileges are subject to the condition of reciprocity, meaning that Filipino citizens must be accorded similar privileges in the alien’s country of nationality.

Repeal of Inconsistent Laws

  • Republic Act No. 1393 and other laws, parts of laws, rules, or regulations inconsistent with this Act are repealed to the extent of such inconsistency.

Effectivity

  • The Act takes effect immediately upon its approval on August 4, 1967.
