Promotion Eligibility and Conditions

  • Promotion requires passing the relevant promotional examination administered by the Commission, the Bar (if applicable), or corresponding professional board exams.
  • Completion of accredited courses at the Philippine National Police Academy (PNPA) or equivalent training institutions is mandatory.
  • Passing required psychiatric/psychological and drug tests is also required.
  • Filing of criminal charges does not automatically bar promotion unless probable cause is found.
  • Police officers with unresolved criminal cases for more than two years after probable cause determination shall still be considered for promotion.
  • If found guilty by final judgment, promotion is rescinded and penalties may be imposed.
  • Police officers facing criminal charges punishable by life imprisonment or reclusion perpetua with strong evidence of guilt are ineligible for promotion during case pendency.

Continuing Education Program

  • The National Police Commission is tasked with designing and implementing a continuing education program for PNP officers and members.
  • Coordination with the Civil Service Commission, Commission on Human Rights, and Commission on Higher Education is mandated.
  • The program may utilize distance education and/or in-service training.
  • Focus areas include law enforcement, criminal investigation, human rights, or similar topics.

Implementing Rules and Regulations

  • The National Police Commission and Philippine National Police must promulgate rules and regulations for effective implementation of this Act.
  • Such rules take effect upon publication in two newspapers of general circulation.

Separability Clause

  • If any provision is declared unconstitutional or invalid, the remaining provisions continue to be in full force and effect.

Repealing Clause

  • Inconsistent laws, decrees, executive orders, rules, regulations, and issuances are repealed, amended, or modified accordingly.

Effectivity

  • The Act takes effect fifteen days after its full publication in at least two newspapers of general circulation.
