Extension of Tariff Concessions and Special Treatment
- The waiver included terms and concessions on rice, and reduced Most Favoured Nation (MFN) duty rates on some agricultural products.
- Executive Order No. 190 (2015) implemented these tariff concessions.
- The waiver would cease on July 1, 2017.
Presidential Authority Under RA No. 10863
- Section 1608 of RA No. 10863 empowers the President to modify import duty rates upon NEDA's recommendation.
- On February 20, 2017, NEDA approved extending reduced duty rates for three more years.
Section 1: Application of MFN Rates to Specified Agricultural Products
- Articles listed in Annexes A and B, classified per Section 1611 of RA No. 10863, are subject to MFN rates in specified columns of the Annexes.
- This applies from the law's effectivity on goods entered or withdrawn from warehouses.
Section 2: Status of Tariff Headings with "XXX"
- Nomenclature and duty rates for tariff headings not listed or marked "XXX" remain in effect.
Section 3: Minimum Access Volume (MAV) on Rice
- The MAV commitment of 805,200 metric tons on rice made under the waiver remains in force.
Section 4: Repeal of Conflicting Issuances
- All administrative rules and issuances inconsistent with this Order are repealed or modified.
Section 5: Separability Clause
- If any provision is invalid or unconstitutional, the rest of the Order remains effective.
Section 6: Effectivity and Duration
- The Order takes effect immediately upon publication and is applicable until June 30, 2020, or until an amendment law on rice tariffication is passed.
- After expiration, MFN rates in Column 8 of the Annexes shall apply.
