Scope

Responsibilities of ICTSI

  • Develop, establish, and operate a DCA conforming to international standards and relevant PPA administrative orders.
  • Ensure all dangerous cargoes have appropriate permits from agencies such as PNP, DENR-EMB, Philippine Nuclear Research Institute.
  • Formulate emergency and contingency plans.
  • Provide personal protective equipment for all personnel dealing with dangerous cargoes.
  • Assign only competent, trained personnel to the DCA.
  • Conduct continuous training on handling and storage.
  • Ensure proper segregation and stacking of dangerous cargoes.

Safety Requirements

Warehouse Requirements

  • Separate drainage system with shut-off valves and facilities for contaminated water disposal.
  • Proper ventilation.
  • Constructed with fire-resistant walls and ceilings equipped with explosion-proof lighting.
  • Safety signs and markings for cargo segregation.
  • Adequate firefighting equipment per PPA standards.
  • Aisles at least 3 meters wide, clearly marked.
  • Safe stacking and segregation observed.

Container Yard Requirements

  • Adequate space for segregating incompatible cargoes and different dangerous cargo classes.
  • Safety signs and proper classification markings.
  • Safe stacking and segregation in accordance with IMDG Code.
  • Adequate emergency access.
  • Drainage with shut-off valves and facilities for contaminated water treatment.

Special Covered Area

  • Provided for repacking damaged dangerous cargoes and storage of contaminated waste awaiting disposal.

Procedures

Handling Permits

  • Shippers or brokers must secure Dangerous Cargo Handling Permits from PPA before arrival of import/export dangerous cargo.
  • Import/export permits for explosive and radioactive materials, and chemical substances covered by RA 6969, must be secured by the shipper/importer/exporter.

Dangerous Cargo Manifest Submission

  • Inbound cargo manifests and permits must be submitted to ICTSI Safety Officer 24 hours before vessel arrival.
  • Outbound cargo manifests and permits must be submitted similarly 24 hours prior to cargo arrival or delivery.
  • ICTSI Safety Officer reviews manifests for cargo classification and ensures segregation.

Cargo Handling

  • Imported dangerous cargo must be discharged directly to the DCA unless direct-to-truck delivery is required.
  • Export dangerous cargo is received directly at the DCA unless operational constraints require otherwise.
  • ICTSI Safety Officer provides copies of Dangerous Goods Manifests to PPA Field Office and Safety & Environmental Management Division (SEMD).
  • Undeclared dangerous cargoes found in manifests are listed and coordinated for proper classification and transfer to DCA.
  • Importer’s LCL dangerous cargo must be stripped from containers before transfer to DCA; conversely, export LCL cargo is received first at DCA before stuffing.

Arbitration

  • Discrepancies in declaration, identification, or classification of dangerous cargoes are referred to PPA’s Assistant General Manager for Operations, SEMD for resolution.

Exclusion of Certain Cargoes

  • Radioactive and explosive substances under categories 1.1, 1.2, and 1.3 are prohibited from storage within the port zone.
  • These cargoes must be delivered directly to consignee’s storage located outside the port.
  • Categories 1.4, 1.5 and 1.6 may be stored in limited quantities with round-the-clock attention and PPA approval.
  • Non-compliance or inability to store these may result in transfer to DASSAD Warehouse, Pier 18, North Harbor, with approval.

Special Charges

  • ICTSI shall collect special handling and storage charges for dangerous cargoes at the DCA:
    • Containerized cargo: P2,690 per TEU
    • LCL (non-palletized): P141 per revenue ton
    • LCL (palletized): P111 per revenue ton
  • These charges are in addition to premium charges under PPA Administrative Order No. 02-98.

Storage Guidelines

  • Regular free storage periods for import and export cargoes are applicable.

Monitoring and Inventory

  • ICTSI must submit monthly reports to PPA within the first week of the succeeding month detailing volumes of dangerous cargoes handled in TEUs for FCL and tonnage for LCL.

Repealing Clause

  • All inconsistent PPA Orders, Circulars, Memoranda, rules, regulations and guidelines are modified, repealed or amended accordingly.

Penalty Clause

  • Violations of the Order subject involved persons or entities to penalties under Section 43 of PD 857 and applicable laws.

Effectivity

  • The Order takes effect four (4) months after publication in newspapers of general circulation.
