Plebiscite requirements and permanent capital
- Section 1 requires a plebiscite in the Subprovince of Siquijor to determine whether it will separate from the Province of Oriental Negros.
- Section 1 mandates that separation is approved only if a majority of the votes cast in the Subprovince of Siquijor favor separation.
- Section 1 requires that the same plebiscite decide the permanent capital through a direct vote by registered electors.
- Section 1 directs registered electors to answer: "Which of the six municipalities of the Province of Siquijor do you choose as the capital of the Province of Siquijor", writing the chosen municipality.
- Section 1 requires that the municipality with the highest number of votes, as certified by the Commission on Elections, becomes the permanent capital.
- Section 1 requires the President of the Philippines to proclaim the chosen permanent capital within thirty days after receipt of the Commission on Elections certification.
Continuity of elected provincial officials
- Section 2 provides that the governor, vice-governor, and members of the provincial board elected in the general elections of nineteen hundred and seventy-one for the Subprovince of Siquijor automatically become the provincial officials of the Province of Siquijor.
- Section 2 requires those officials to hold office until their successors are elected and qualified.
Territory and application of governing laws
- Section 3 states that the Province of Siquijor consists of the present territory of the Subprovince of Siquijor.
- Section 3 applies the Administrative Code and other laws to the province’s government and operations insofar as they are applicable to a regularly organized province.
- Section 3 covers application to election, appointment, and remuneration of the province’s officers.
Representation in Congress
- Section 4 provides that the member of the House of Representatives for the Province of Siquijor shall be elected in the next presidential elections.
- Section 4 provides that the present Representative for the Second District of the Province of Oriental Negros continues to represent the new Province of Siquijor during the term of office as Representative.
Transfer of funds, obligations, and property
- Section 5 provides that the funds, obligations, and property of all kinds owned by and/or assigned to the Subprovince of Siquijor become the property of and/or be assigned to the Province of Siquijor upon establishment.
Transfer of named provincial personnel
- Section 6 provides that the following officials of the Subprovince of Siquijor become the corresponding officials of the new Province of Siquijor:
- fiscal
- sub-provincial assessor
- division superintendent of schools
- district engineer
Continuation of appointive officials
- Section 7 provides that all other appointive officials of the Subprovince of Siquijor continue holding their respective offices in the province created.
- Section 7 provides that the heads of the various offices continue as heads but with corresponding changes in their official designations.
When corporate existence begins; constitutional convention seat
- Section 8 provides that the Province of Siquijor commences its corporate existence upon the election of the officials of the new province in the general elections for local officials in nineteen hundred and seventy-one.
- Section 8 provides that Siquijor is not entitled to any delegate as a separate province in the Constitutional Convention.
- Section 8 provides that Siquijor continues as part of the Second Congressional District of the Province of Negros Oriental.
Repeal and effectivity
- Section 9 repeals all Acts or parts of Acts inconsistent with the Act.
- Section 10 provides that the Act takes effect upon approval.
- The Act was approved on September 17, 1971.
