Seniority Rules for AFP Regular and Reserve Officers

Republic Act No. 5206 amends Section 22, paragraph (e) of Commonwealth Act No. 1, as amended.
Republic Act No. 5206 focuses specifically on determining relative standing and precedence in seniority between:
- officers in the regular force; and
- officers in the reserve force of the Armed Forces of the Philippines.
Section 1 supplies the operative seniority rule for officers of the same permanent grade.

Section 1 establishes a clear standard for determining seniority and precedence between regular force and reserve force officers of the Armed Forces of the Philippines.
Republic Act No. 5206 ensures seniority determinations are governed by a defined set of comparison criteria based on active commissioned service.

Section 1 provides that, for officers of the same permanent grade, seniority depends first on longer active commissioned service in that permanent grade.
Officers with longer active commissioned service in that permanent grade are the senior.
If two officers have the same active commissioned service in permanent grade, Section 1 makes seniority depend on the longer accumulated active commissioned service in the Armed Forces of the Philippines.
If neither of the foregoing cases applies, Section 1 directs the Secretary of National Defense to determine the relative seniority of officers concerned.

Section 1 applies to:
- officers of the regular force of the AFP; and
- officers of the reserve force of the AFP.
Section 1 applies when the officers are of the same permanent grade.
Section 1 governs the determination of relative standing and precedence in seniority between the specified regular and reserve officers.

Section 1 assigns the Secretary of National Defense the authority to determine relative seniority when the officers’ situation is not covered by the comparison rules based on:
- active commissioned service in the permanent grade; and
- accumulated active commissioned service in the AFP.
The Secretary of National Defense determines the relative seniority of officers concerned as the controlling tie-breaker for such cases.

Section 2 repeals or modifies all Acts, executive orders, Armed Forces of the Philippines regulations, or parts of those measures that are inconsistent with Republic Act No. 5206.
Section 3 provides that Republic Act No. 5206 takes effect upon approval on June 15, 1968.
Section 2 operates to resolve conflicts by repealing or modifying only those provisions that are inconsistent with the Act’s seniority rules.
