Creation of AFP 1st Chief Master Sergeant Rank

Section 1 of RA 11221 amends Section 55 of Republic Act No. 9387 (the “Charter of the City of Navotas”).
Section 2 directs the Department of Justice and the Department of Budget and Management to implement the Act.
Section 3 amends, repeals, or modifies inconsistent laws, decrees, executive orders, rules and regulations accordingly.

RA 11221 requires the establishment in the City of Navotas of a prosecution service (Section 55(a), as amended).
The prosecution service in Navotas must be headed by a city prosecutor (Section 55(a), as amended).
The prosecution service must be staffed with such number of assistant city prosecutors as may be necessary (Section 55(a), as amended).
The Navotas prosecution service forms part of the Department of Justice (DOJ) and remains under the supervision and control of the Secretary of Justice (Section 55(a), as amended).
The qualifications, manner of appointment and rank, salary and benefits of the prosecutors are governed by existing laws covering prosecutors in the DOJ (Section 55(a), as amended).

The city prosecutor must handle the prosecution of cases (Section 55(b), as amended).
The city prosecutor must also perform such other functions as provided by law and its implementing rules and regulations (Section 55(b), as amended).

The existing City Prosecution Service in the City of Malabon must continue to function pursuant to existing laws (Section 55(b), as amended).
The Malabon prosecution service remains under the supervision of the city prosecutor in Navotas (Section 55(b), as amended).

The Secretary of Justice must ensure the adequacy and the quality of the prosecution service in the City of Navotas (Section 55(b), as amended).
If there is absence, lack or insufficiency in the number of assistant city prosecutors, the Secretary of Justice must designate from among the assistant provincial prosecutors a sufficient number to perform and discharge the functions of the City Prosecution Service (Section 55(b), as amended).

The public schools division for the cities of Malabon and Navotas must continue to administer public education in both local government units (Section 55(b), as amended).

The Department of Justice and the Department of Budget and Management must implement RA 11221 (Section 2).
Section 3 provides that all laws, decrees, executive orders, rules and regulations inconsistent with RA 11221 are amended, repealed or modified accordingly.

RA 11221 provides an effectivity rule under Section 4, requiring publication in the Official Gazette or in a newspaper of general circulation followed by fifteen (15) days before effectivity.
