The Bureau of Customs establishes the Super Green Lane Plus Import Processing Facility to streamline customs clearance for accredited importers, offering enhanced benefits such as audit suspensions and exemptions from the Selectivity System.

Legal basis and prior rules

Scope and covered transactions

  • The Order covers shipments to the Philippines by importers currently accredited with Super Green Lane Plus (SGL Plus) transactions under the rules it promulgates.
  • The Order’s scope is anchored on being accredited for SGL Plus under the program rules.

Organization and implementation oversight

  • The Commissioner of Customs constitutes the Super Green Lane Plus Task Group.
  • The Task Group is headed by the Deputy Commissioner, Intelligence Group.
  • The Task Group supervises implementation of the SGL Plus and performs these functions:
    • Identifies importers presently qualified to avail of the SGL Plus and makes recommendations.
    • Conducts post clearance checks on declarations covering shipments released under SGL Plus.
    • Ensures compliance with rules governing the establishment and operation of SGL Plus.
    • Performs other functions assigned by the Commissioner from time to time.
  • The Commissioner may create sub-group/s upon the Task Group’s recommendation to carry out the mandate and monitor implementation.

Accreditation eligibility criteria

  • To qualify for accreditation and benefits, an applicant must meet the criteria in Sections 4.1 to 4.4:
    • Must have been transacting with the BOC for at least one (1) year prior to the date of application, with a clear and specific nature of business.
    • Must have a good reputation based on its track record.
    • Must not have misused customs facilities for at least one (1) year prior to application, and must not have been subject of derogatory information.
    • Must be willing to undergo compliance audit.

Benefits and additional privileges

  • An accredited SGL Plus member receives benefits in addition to those granted to regular SGL members.
  • The benefits granted under Section 5.1 are:
    • Three (3) Year Suspension on the conduct of audit.
    • Five (5) Year validity of the Importer’s Accreditation.
    • Permission to import articles not included in the List of Importables; however, the SGL Plus member must still submit its List of Importables and the expected volume of importation for a given year for monitoring.
    • Exemption from the Selectivity System.
    • 24-hour Client Coordinator Service handling queries and concerns of the SGL Plus member.
  • Upon recommendation of the SGL Plus Task Group, the Commissioner of Customs may provide additional benefits to SGL Plus members, subject to approval of the Secretary of Finance.

Certificate of Accreditation conditions and grounds

  • Privileges under a Certificate of Accreditation (CA) issued by the Commissioner are subject to conditions under Section 6.1.1 to 6.1.4:
    • The importer is a registered SGL-user.
    • Covered shipments may be subject to a duly authorized random and/or spot check inspection but only at the importer’s premises while the goods are being unloaded/stripped thereat.
    • The importer is responsible for any misuse or abuse of the privilege.
    • The importer must comply with all rules and regulations promulgated by the Bureau of Customs for implementing the Super Green Lane Plus Program.
  • Any willful violation or contravention of the CA is a ground for suspension, revocation, or cancellation imposed after due notice.
  • The CA is subject to review by the BOC.
  • The CA is valid until revoked or cancelled.

Super Green Lane Plus procedures and service fee

  • The Commissioner of customs issues the necessary rules and regulations for implementing the SGL Plus facility.
  • Accredited importers must continue paying a service fee for every entry filed through the SGL facility.
  • The service fee is computed based on F.O.B value using the following schedule:
    • Below US $5, 000: Php 500.00
    • US$5, 001 to US$ 100,000: Php 1,000.00
    • US$100,001 to US$200, 000: Php 1,500.00
    • US$200,001 to US$500, 000: Php 2,000.00
    • Above US$500,000: Php 2,500.00

Confidentiality and disclosure limits

  • Information that is by nature confidential or is provided on a confidential basis for accreditation must be treated as strictly confidential by the authorities concerned.
  • Authorities must not disclose such information without specific permission of the persons or government providing it.
  • Disclosure is allowed only to the extent it is required in the context of judicial proceedings.

Repeal, separability, and immediate effect

  • All Orders, Memoranda, Circulars, or parts thereof that are inconsistent with this Order are deemed revoked, amended, and/or modified accordingly.
  • Revocation, amendment, or modification is made without prejudice to the importer’s accreditation scheme agreed upon by the Department of Finance and the Department of Trade and Industry.
  • If any part is declared unconstitutional or contrary to existing laws by the Court, the other parts remain in full force and effect.
  • The Order’s effectivity is immediate.
