Scope of the Order
- Applies to shipments imported into the Philippines
- Covers importers qualified for Super Green Lane (SGL) transactions
- Implementation may be gradual
Organizational Structure
- Commissioner of Customs to form the Super Green Lane Task Group headed by a Deputy Commissioner
- Task Group Functions:
- Identify qualified importers for SGL and recommend them
- Conduct post-clearance checks on shipments released under SGL
- Ensure compliance with SGL rules and regulations
- Perform other duties as assigned by Commissioner
- Commissioner may create sub-groups based on Task Group recommendations
Accreditation Criteria for Importers
- No prior disciplinary actions or penalties against importer
- Imports must not be of prohibited goods
- Importer must have at least one year of transaction history with BOC
- Importer must be among the top 1000 importers by duties and taxes paid
Certificate of Qualification (CQ) Provisions
- Conditions for CQ privileges:
- Importer must be a registered BOC Electronic Data Interchange (EDI) user
- Shipments may be randomly or spot-checked at the importer's premises during unloading
- Importer assumes responsibility for any misuse of privilege
- Importer must enter into a Memorandum of Agreement (MOA) with BOC
- Violations of CQ or MOA terms may result in suspension, revocation or cancellation of CQ
- CQ is subject to annual review and valid until revoked or canceled
Super Green Lane Procedures
- Commissioner of Customs to issue implementing rules and regulations for SGL facility
Service Fee
- Qualified importers to pay a processing fee of PHP 2,500 for each entry filed through SGL
Confidentiality Clause
- Information provided for accreditation treated with strict confidentiality
- Disclosure only allowed with explicit permission or as required in judicial proceedings
Repealing Clause
- Revokes or amends any orders, memoranda, or circulars inconsistent with this Order
- Does not affect accreditation schemes agreed by Department of Finance and Department of Trade and Industry
Separability Clause
- If any part is declared unconstitutional or unlawful, remaining provisions stay effective
Effectivity
- The Order takes effect immediately upon promulgation on March 29, 2000
