Scheduling and Notice of Hearings
- Arbitrator, in agreement with parties, fixes the date, time, and place of hearings.
- Written notice of hearing must be given within 24 hours or at least two (2) days in advance.
Conduct of Hearing
- Hearings are conducted in a manner that allows the most efficient presentation of evidence and arguments.
- Arbitrator records minutes of proceedings, which must be signed by the parties and attested by the Arbitrator Voluntary Arbitrator (AVA).
- The minutes form part of the official case records.
Prohibition on Post-Hearing Briefs
- No submission of post-hearing briefs is allowed.
Form and Timing of the Arbitration Award
- Award must be in writing and signed by the arbitrator.
- Accompanied by a brief summary of facts and legal basis of the decision.
- The award must be rendered promptly within seven (7) days from case submission.
Payment of Arbitrator's Fee
- The fee shall not exceed the minimum subsidy of P10,000 as provided in related TVAAC Resolution No. 2, series of 1997.
- Fee payment is covered entirely by the SVAF (presumably a subsidy fund) and paid directly to the arbitrator.
- No cost shall be borne by the disputing parties.
Legal Effect and Compliance
- Awards from the expedited voluntary arbitration are final and binding.
- Both parties must mutually comply with the award without further recourse.
Administrative Approval
- Resolution was approved and adopted on January 6, 1997, by the National Conciliation and Mediation Board (NCMB) with signatures from representatives of government, labor, and management sectors.
