Establishment of the Presidential Commission on Year 2000 Compliance (the Commission)
- Created under the Office of the President.
- Composition: Chairman (Presidential Consultant on Computer Education), key secretaries and directors, plus three private sector experts.
- Members appointed by the President for a 3-year term.
- Must organize and hold first meeting within 30 days of the Executive Order.
Powers and Functions of the Commission
- Conduct study on extent and cost of Y2K damage and readiness of public/private sectors.
- Establish a comprehensive two-year Year 2000 Compliance Plan.
- Recommend incentives for compliant companies and government institutions.
- Take action against non-compliant hardware/software dumping into the country.
- Promote awareness and undertake programs addressing the Y2K problem.
- Monitor compliance status, especially in critical infrastructure.
- Maintain relationships with local/international experts and bodies.
- Collaborate with government and private sector agencies on joint projects.
- Submit periodic and annual reports to the President.
- Recommend legal modifications to remove implementation impediments.
- Ensure all government computer-based systems are Y2K compliant by September 30, 1999.
Organizational Structure and Meetings
- The Commission meets at least twice a month or as necessary.
- Quorum requires majority of members.
- Secretariat to be organized at the first meeting.
Honoraria and Allowances
- Provided for members and personnel, subject to existing regulations.
Chairman and Vice Chairman Roles
- Chairman presides over meetings, supervises and controls operations.
- Vice Chairman acts in absence or vacancy of Chairman and performs other assigned functions.
Technical and Administrative Staff
- Organized under the secretariat, headed by an Executive Director with at least 5 years relevant experience.
- Executive Director is full-time and removable only for cause.
- Staff receives salary and remuneration as determined by the Commission within existing rules.
Term and Duration
- Commission ceases to exist on June 30, 2000, unless extended by law or presidential order.
Rulemaking Authority
- Commission to promulgate implementing rules and regulations.
- Rules take effect 15 days after publication in a newspaper of general circulation.
Separability Clause
- If any provision declared unconstitutional, others remain effective.
Repealing Clause
- All inconsistent laws, orders, rules, and regulations are repealed, amended, or modified accordingly.
Effectivity
- Executive Order takes effect immediately upon promulgation.
