Functions of MARINA

  • Deputizes the PCG for enforcement activities concerning Philippine-registered vessels involved in domestic trade.
  • Verification duties include ensuring compliance with various vessel and crew documents, such as:
    • Certificate of Vessel Registry
    • Pleasure Yacht Registration/Permit
    • Certificate of Number
    • Certificate of Ownership
    • Coastwise License
    • Bay and River License
    • Certificate or Special Certificate of Inspection
    • Permits to operate cargo, fishing vessels, special navigation, inflammable/dangerous cargo
    • Seafarer’s Identification and Record Book (SIRB) and other seafarer-related certificates
    • Motor Boat Operator’s License (MBOL)
  • Verification of compliance with Certificate of Public Convenience (CPC), Provisional Authority (PA), Special Permit (SP), and related terms including:
    • Prescribed routes and schedules
    • Valid passenger insurance for passenger vessels
    • Passenger capacity enforcement
  • Deputizes PCG to issue specified certificates, permits, and licenses ensuring personnel competence and adherence to MARINA procedures:
    • Includes licenses and permits listed above
  • Provides PCG with lists, circulars, qualification standards, forms, and procedures necessary for enforcement
  • Reviews and revokes Memoranda of Agreement that conflict or duplicate PCG’s deputized functions

Functions of the Philippine Coast Guard (PCG)

  • Conducts enforcement activities related to maritime safety rules
  • Issues and serves Inspection Apprehension Reports (IAR) to vessel Masters violating MARINA rules, conducting hearings for fines and penalties
  • Provides IAR copies to Philippine Ports Authority with recommendations to deny departure clearance if warranted
  • Maintains and submits list of inspectors/officers with qualifications and specimen signatures
  • Submits copies of all issuances to MARINA monthly
  • Conducts Emergency Readiness Evaluations (ERE) and Material Readiness Evaluations (MARE)
  • Controls vessel movements during typhoons and adverse weather, informing MARINA and related officials
  • Submits monthly reports to the DOTC Secretary and MARINA Administrator about deputized functions and maritime incidents

Review and Coordination

  • MARINA and PCG shall meet regularly to review, assess, and improve enforcement functions

Revenue Management

  • All revenues from deputized functions shall be properly receipted, recorded, and remitted to the Bureau of Treasury according to DOF and COA rules
  • Deposited income certifications must be submitted monthly to the nearest MARINA office

Repeals and Effectivity

  • Conflicting orders and issuances are repealed or modified accordingly
  • The order takes effect immediately for strict compliance.
