Law Summary
Characteristics of the ECC Fee
- The ECC fee is a one-time assessment only.
- It does not have an expiration period.
- Upon use, the receipt for the ECC fee shall be distinctly crossed out to prevent reuse.
Special Provision for Balikbayans
- The 59-day period and ECC fee assessment for Balikbayans begin only after the expiration of their one (1) year authorized stay.
- This means that Balikbayans enjoy a longer initial stay before being required to pay the ECC fee for extensions beyond 59 days.
Non-Applicability and Change of Admission Category
- The ECC fee applies solely to tourists and temporary visitors.
- Individuals who have applied for and secured a change of admission category are exempt from paying the ECC fee.
- For those who have changed admission category, applicable fees corresponding to the new status will be assessed.
- ECC fees already paid by those who change their admission category become moot and are forfeited in favor of the government.
Enforcement and Compliance
- The memorandum order enforcing this directive was adopted on February 11, 2002.
- The Philippine Immigration Commissioner mandates strict compliance with these provisions.
- The measure serves to regulate the length of stay of tourists and temporary visitors and ensure proper fee collection upon extensions beyond 59 days.
