Territorial boundaries and technical descriptions
- Each newly created barangay is bounded by specific adjacent barangays and defined by technical description lines and tiepoints.
- The Act provides a technical description for each barangay using tiepoints, bearings, distances, and a stated land area (more or less).
- Barangay Magugpo Poblacion is bounded by Barangay Magugpo East, Barangay Visayan Village Case-16, Barangay Magugpo South, Barangay Magugpo West, and Barangay Magugpo North (with specified boundary line segments).
- Barangay Magugpo East is bounded by Barangay Magugpo North Case-2, Barangay Magdum Case-14, Hijo River, Barangay Apokon Case-15, Barangay Visayan Village Case-16, and Barangay Magugpo Poblacion Case-1 (with specified boundary line segments).

Plebiscite conduct and substantial compliance
- The plebiscite conducted and supervised by the Commission on Elections (COMELEC) in Barangay Magugpo on May 29, 1994 pursuant to Provincial Ordinance No. 2, S-1993 of the Province of Davao del Norte serves as substantial compliance with the plebiscite requirement under Section 10 of Republic Act No. 7160, as amended, or the Local Government Code of 1991.
- The plebiscite is tied to the ratification of the division into the five (5) barangays: Barangay Magugpo Poblacion, Barangay Magugpo East, Barangay Magugpo West, Barangay Magugpo North, and Barangay Magugpo South.
- The Act treats the prior plebiscite as satisfying the legal plebiscite requirement for the creation of the barangays.
Incumbent officials continue holding office
- Incumbent barangay officials of Barangay Magugpo Poblacion, Barangay Magugpo East, Barangay Magugpo West, Barangay Magugpo North, and Barangay Magugpo South continue to hold office.
- Continuation of office lasts until their successors have been duly elected and qualified.
Transfer of public infrastructure and facilities
- All public infrastructure and facilities for public use existing in the affected area at the time of approval of the Act are transferred without cost or compensation.
- The transferred infrastructure and facilities are administered by the new barangays created by the Act.
Internal Revenue Allotment (IRA) entitlement
- All barangays created by the Act—Barangay Magugpo Poblacion, Barangay Magugpo East, Barangay Magugpo West, Barangay Magugpo North, and Barangay Magugpo South—are entitled to Internal Revenue Allotment (IRA) shares.
- IRA entitlement is under Section 285 of Republic Act No. 7160, as amended, or the Local Government Code of 1991.
Effectivity after publication
- Republic Act No. 10954 takes effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
- Approval date is October 30, 2017.

- Republic Act No. 10954 is titled: “AN ACT DIVIDING BARANGAY MAGUGPO IN THE CITY OF TAGUM, PROVINCE OF DAVAO DEL NORTE INTO FIVE (5) DISTINCT AND INDEPENDENT BARANGAYS TO BE KNOWN AS BARANGAY MAGUGPO POBLACION, BARANGAY MAGUGPO EAST, BARANGAY MAGUGPO WEST, BARANGAY MAGUGPO NORTH AND BARANGAY MAGUGPO SOUTH.”
- The Act is approved by Rodrigo Roa Duterte, President of the Philippines, on October 30, 2017.
- The Act was passed by the House of Representatives on March 8, 2017, amended by the Senate on August 14, 2017, and amendments were concurred in by the House of Representatives on September 12, 2017.
