Constitutional and Legal Basis
- The Executive Order is anchored on Section 22, Article VII of the 1987 Constitution, which requires the President to submit the yearly national budget to Congress as the basis of the General Appropriations Bill.
- Executive Order No. 292 (Administrative Code of 1987) assigns to the DBM the duty to assist the President in preparing the national budget as an instrument of national development to ensure effective use of public funds (Section 3, Chapter I, Title XVII, Book IV referenced in the preamble).
- The Executive Order strengthens results-orientation in budgeting and requires full transparency and accountability in government expenditure operations (stated purpose in the WHEREAS clauses).
Coverage and Database Creation
- The DBM must establish a Comprehensive Database on Government Manpower within three (3) years from March 30, 2011 (Section 1).
- The existing Government Manpower Information System (GMIS) must be enhanced to provide a complete and accurate database of:
- all positions;
- incumbents; and
- authorized compensation
for the Executive, Legislative, and Judicial Branches, including Constitutional Offices (Section 1).
- The database coverage must include GOCCs and GFIs (Section 1).
- The enhancement requirement also supports coverage for personnel categories the existing GMIS did not cover, including the military personnel of DND, uniformed personnel of DILG and the Philippine Coast Guard, and other non-covered categories referenced in the preamble.
Mandatory Agency Personnel Submission
- All heads of departments and agencies of the national government must submit immediately to the DBM complete information, including:
- positions,
- incumbents, and
- authorized compensation
on their respective civilian, military, and uniformed personnel complement (Section 2).
- Submission must cover personnel regardless of whether they are regular, casual, or contractual and regardless of the funding source of their Personal Services (PS) requirement (Section 2).
- DND, DILG, the Philippine Coast Guard, and the National Mapping and Resource Information Authority must submit their roster of military or uniformed personnel, as applicable, within the first half of 2011 (Section 2).
Responsible Budgeting and Link to PS
- Heads of departments and agencies of the national government must ensure that their proposed PS requirement is computed based on the personnel information submitted to the DBM and computed according to their respective authorized compensation (Section 3).
- The DBM, during review of proposed budgets of national government agencies (including GOCCs, GFIs, and Constitutional Offices), must recommend the PS requirement only if it is consistent with the Comprehensive Database on Government Manpower (Section 3).
- The national government (including GOCCs and GFIs, and Constitutional Offices) must provide and must make payments only for the authorized compensation of personnel as reflected in the Comprehensive Database on Government Manpower (Section 3).
- Payments made beyond or in excess of the authorized compensation reflected in the database constitute illegal disbursement of public funds and must render responsible officials administratively and criminally accountable (Section 3).
- The DBM, in coordination with the Civil Service Commission (CSC), must conduct a risk-based personnel audit of government agencies’ manpower complement on a regular basis (Section 3).
Scope of Authorized Compensation
- “Authorized compensation” in the Executive Order refers to:
- basic salary, and
- allowances and benefits, and
- incentives
authorized under Republic Act No. 6758 (Salary Standardization Law), as amended, or the respective charters of agencies and entities exempted from the coverage of that law, as amended (Section 4).
Updating, Technology, and Systems Linkage
- Departments and agencies of the national government (including GOCCs, GFIs, and Constitutional Offices) must regularly update the Comprehensive Database on Government Manpower to reflect all changes in positions and incumbents (Section 5).
- The DBM must use advances in information technology to further enhance the database and ensure reliability and transparency (Section 6).
- The database must be linked with personnel information systems of:
- the CSC,
- the Government Service Insurance System,
- the Bureau of Internal Revenue, and
- other concerned agencies of the government,
including human resource management information systems and payroll systems administered by different agencies (Section 7).
Confidentiality Requirements
- The DBM must protect the confidentiality of all data and information gathered and stored in the database (Section 8).
- Any breach of confidentiality or unauthorized disclosure makes the responsible officials administratively and criminally liable under existing laws (Section 8).
Implementing Rules, Repeal, Separability, and Duration
- The DBM must issue implementing rules and regulations to ensure proper implementation and immediate compliance with the Executive Order (Section 9).
- All orders, rules, regulations, issuances, or parts that are inconsistent with the Executive Order are repealed or modified accordingly (Section 10).
- If any provision is declared invalid or unconstitutional, the remaining provisions continue to be valid and subsisting (Section 11).
