Legal Authority to Adopt Professional Standards
- The Professional Regulation Commission (PRC) is empowered by Republic Act No. 8981 (PRC Modernization Act of 2000), specifically Sections 5 and 7(a), to adopt policies that enhance and maintain high professional, technical, and ethical standards.
- These powers include adopting a Code of Good Governance for professionals.
Objectives of the Code of Good Governance
- To promote ethical awareness among Filipino professionals.
- To instill a sense of public accountability in professionals for their liability toward the public.
- To ensure full professional obligation is met towards clients.
- To enhance both technical and ethical proficiency of professionals.
- To update professionals on modern trends and technology.
- To assure high-quality and globally competitive professional services.
- To safeguard public safety and protection through ethical and competent professional practice.
Mandatory Adoption and Applicability
- The Code of Good Governance is mandated to be adopted by all registered professionals in the Philippines.
Implementation and Enforcement Mechanisms
- The Governance Advisory Council and the PRC are tasked to implement and enforce the Code.
- Implementation efforts include collaboration with government agencies and civil society.
- Enforcement is conducted through the Professional Regulatory Boards (PRBs), supervised and controlled by the PRC.
Development of Enforcement Guidelines
- The PRC will issue necessary guidelines and procedures for enforcing the Code.
- These guidelines are made after consultation with and upon recommendation of the respective Professional Regulatory Boards.
Repealing Clause
- Any executive issuance, orders, or provisions inconsistent with this Executive Order are considered modified or repealed.
Effectivity
- The Executive Order, and thus the adoption of the Code of Good Governance, takes immediate effect upon issuance.
